72R-140 ...-- RESOLUTION NO. 72R-140 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AHENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim has heretofore duly passed and adopted a resolution recommending denial of a change in the boundaries of the zone or zones hereinafter mentioned and described, after having fixed a time and place for the holding of a public hearing thereon in the manner and as prescribed in Title 18 of the Anaheim Municipal Code, and after having duly held and conducted such public hearing to consider said proposed change of zone or zones, and after having received evidence and reports from persons interested therein; and WHEREAS, within a period of forty (40) days following the hearing thereon, the Planning Commission did duly announce by formal resolution its findings of facts and declare its opinions and reasons for recommending denial of said proposed change in the boundaries of the zone or zones hereinafter mentioned and described; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission, the City Council did fix the 2qt:h day of ""..h,."..,.y , 19.:1.2.-' and continued to the 18th day of ~ ri1 , 19~, as the time, and the City Council Chamber~ 1n the City HaIr in the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, here- inafter described, from the zone in which it is now situated and the incorporation thereof in the zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendations; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zOne or zones in which it is now situated; and incorporated in the zone or zones as hereinafter set forth. ,.-.,. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that all of the property and area situated in the City of Anaheim, County of Orange, State of California, described as follows: -1- 71-72-30 PORTION A: -- Being a portion of the Rancho santiago De Santa Ana and a portion of the Rancho Canon de Santa Ana, being also portions of section 36, Township 3 South, Range 9 west, Section 1, Township 4 South, Range 9 West, and Section 31, Township 3 South, Range 8 West, S.B. & M., in the county of Orange, State of California, described as a whole as follows: Beginning at the intersection of the west line of Lot 26 in Tract No. 117 as shown on map recorded in Book 11, page 15, of Miscellaneous Maps, in the office of the County Recorder of said county, with the south- easterly line of that certain 278.00 foot wide strip of land described as course number 11, having a bear- ing of North 600 38' 00" East and a length of 4951.37 feet, in deed to the state of California recorded in Book 8474, page 102, of Official Records, records of said county; thence southerly along said west line of Lot 126 to a point in the northwesterly line of the Santa Ana valley Irrigation Company canal right of way, 33.00 feet wide, as described in deed recorded in Book 685, page 255, of Official Records, records of said county; thence South 530 15' 18" East, as measured at right angles to that certain course in the northwesterly line of Santa Ana Canyon Road, as des- cribed in deed to State of California recorded in Book 691, page 27, of Official Records, records of said County, as having a bearing of North 360 38' 30" East and a length of 597.52 feet, to a point in said north- westerly line; thence South 360 44' 42" West along said course and northwesterly line 150.00 feet more or less to the beginning of a tangent curve concave southeast- erly and having a radius of 3050.00 feet; thence con- tinuing southwesterly along the various courses of said northwesterly line of Santa Ana Canyon Road, as same existed on January 11, 1972, to a point in the easterly line of that certain 10.937 acre parcel as shown on Record of Survey Map recorded in Book 18, page 46, of Surveys, records of said County of Orange; thence northerly along said easterly line to an angle point therein; thence northwesterly along said easterly line 628.00 feet more or less to the northeast corner of said 10.937 acre parcel; thence southwesterly and westerly along the northerly boundary of said parcel of land to the northwest corner thereof; thence North 280 36' 24" West along the northwesterly prolongation of the southwesterly line of said 10.937 acre parcel to a point in the aforesaid course no. 11 in the south- easterly line of the said 278.00 foot strip of land of the State of California; thence North 60. 38' 00" East along said course and southeasterly line to the point of Beginning. PORTION B: .,-~- Being Lot 25 in Tract No. 117 as shown on map recorded in Book 11, page 15 of Miscellaneous Maps, in the office of the County Recorder of the County of Orange, State of California, excepting that portion lying southwest- erly of the following described line: -2- .,......... Beginning at the intersection of the west line of Lot 26 in said Tract No. 117 with the northwesterly line of the Santa Ana Valley Irrigation Company canal right of way, 33.00 feet wide, as shown on said map of Tract No. 117; thence South 530 15' 18" East, as measured at right angles, to that certain course in the northwesterly line of Santa Ana Canyon Road, as described in deed to State of California, recorded in Book 691, page 27, of Official Records, records of said County, as having a bearing of North 360 381 30" East and a length of 597.52 feet. ALSO EXCEPTING those portions of said Lot 25 lying within the limits of Santa Ana Canyon Road as same existed on January 11, 1972. be excluded from the R-A, AGRICULTURAL ZONE, and incorporated in the R-l, ONE-FAMILY RESIDENTIAL ZONE, subject to the follow- ing conditions: 1. That these reclassification proceedings are granted subject to the completion of annexation of sllbject pxoperty to the City of Anaheim. 2. That a final tract map of subject property shall be submitted to and approved by the City Council and then be recorded in the office of the Orange County Recorder. 3. That the owners of subject property shall pay to the City of Anaheim the appropriate park and recreation in-lieu fees as determined to be appropriate by the City Council; said fees to be paid at the time the building permit is issued. 4. That ordinances reclassifying the property shall be adopted as each parcel is ready to comply with conditions pertain- ing to such parcel, provided, however, that the word "parcel" shall mean presently existing parcels of record, and any parcel or parcels approved by the City Council for a lot split. 5. Prior to the introduction of an ordinance rezoning subject property, final elevation and floor plans shall be sub- mitted to and approved by the City Council. 6. Prior to the introduction of an ordinance rezoning subject property, Conditions Nos. 1 and 2, above mentioned, shall be completed. The provisions or rights granted by this resolu- tion shall become null and void by action of the City Council unless said conditions are complied with within 180 days from the date hereof or such further time as the City Council may grant.
