1946-1504RESOLUTION NO. /'479 RESOLUTION GRANTING A VARIANCE WHEREAS, M. L. Todd, as Lessee, of certain real property situated in the City of Anaheim, County of Orange, State of Cali- fornia, described as Lots 54 and 55 of the Langenberger Tract, has filed with the City Planning Commission of the City of Anaheim a petition requesting that a variance be granted permitting the oper- ation of the business of a service station on said real property; and WHEREAS, the City Council finds from consideration and investigation of the facts and the report and recommendations of the City Planning Commission that: (1) Special circumstances and exceptional conditions do exist as to the above described real property that do not apply generally to the property or classes of uses in the same zone or district. (2) That a variance is necessary for the preservation and enjoyment of a substantial property right of said petitioner. (3) That the granting of such conditional variance will not be detrimental to the public welfare or injurious to the pro- perty or improvements in the district wherein said property is lo- cated, provided the conditions hereinafter set forth are complied with and WHEREAS, the City Clerk finds that a variance is not necessary as to lot 54. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANAHEIM, that a conditional variance be the same as hereby granted as to Lot 55 of the Langenberger Tract in the City of Anaheim, County of Orange, State of California whereby the business of operating a service station may be maintained and operated upon said real property upon the following conditions: 1. That said business shall be operated in accordance with all laws of the State of California and ordinances and regu- 1. lations of the City of Anaheim. 2. That the appearance of said real property including all buildings and improvements thereon shall be kept and main- tained with a satisfactory appearance in keeping with the use herein permitted, upon the condition that any buildings, struc- tures and improvements upon Lot 54 shall be set back ten (10) feet from the East Property Line thereof to allow for the widening of Lemon Street.
