WHEREAS, the owner of certain real property situated in the City of Anaheim, County of Orange, State of California, de- scribed as: Lots 11, 12, 13, 14, 15, 17, 19, 21, 23, 25, 27 and 29 of Anaheim Home Tract, as shown on a map recorded in Book 6, Page 34 of Miscellaneous Maps, Records of Orange County, California, has filed with the City Planning Commission of the City of Anaheim a petition requesting that a variance be granted permit- ting said above described real property to be used for the erection and maintenance thereon of an Auto Court and Trailer Park Combina- tion and restaurant; and, WHEREAS, the City Council finds from consideration and in- vestigation of the facts and the report and recommendations of the City Planning Commission that: (1) Special circumstances and exceptional conditions do exist as to the above. described real property that do not apply generally to the property or classes of uses in the same zone or district. (2) That a variance is necessary for the preservation and en- joyment of a substantial property right of said petitioner. t3) That the granting of such conditional variance will not be detrimental to the public welfare or injurious to the property or improvements in the district wherein said property is located, provided the conditions hereinafter set forth are complied with. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANAHEIM, that a conditional variance is hereby granted where by the above described real property may be used for the erection and maintenance thereon of an Auto Court and Trailer Park Combination and restaurant subject to the following conditions: (1) That the buildings comprising such Auto Court and Trailer Park Combination and restaurant shall be of the size and placed upon 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 said real property at the locations shown on that certain plat des- ignated "EXHIBIT A attached hereto and made a part hereof. (2) That no additional buildings shall be placed upon said real property without first obtaining the consent of the City Coun- cil of the City of Anaheim, which consent shall be embraced in a resolution adopted by said City Council. (3) That no trailers shall be placed, parked or stationed upon said real property except: a. Upon the Northerly 121 feet of said real property. b. Along the Easterly 39 feet of said real property, but not nearer North Los Angeles Street than 140 feet, measured along the Easterly boundary line of said real property. (4) That said Easterly portion of said real property where trailers are permitted, shall be completely screened from view from North Los Angeles Street by means of shrubbery. (5) That the cabins comprising such Auto Court shall be of the type shown on that certain plan designated "Exhibit B" attached hereto and made a part hereof. (6) That that certain building shown on said Exhibit A and situated on the Southeast portion of said Exhibit A and designated "CAFE" shall be the only location where a restaurant may be erected and maintained on said real property. (7) That said real property and all buildings thereon shall be kept in a neat and attractive condition. (8) That said Auto Court, Trailer Park and restaurant shall be erected, established and maintained in accordance with the Ordinances of the City of Anaheim, the laws of the State of California and of the United States of America and of all rules and regulations of the officers, bureaus and agencies thereof. BE IT FURTHER RESOLVED, that in the event that the person or persons occupying, using or having control of said real property at any time use said real property in violation of the terms of this Resolution and /or the conditions herein set forth or in violation of 2 1 2 3 4 5 7 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 any ordinance of the City of Anaheim, or any laws of the State of California, or in such manner as to constitute a public nuisance, the City Council of the City of Anaheim may terminate the variance granted by this Resolution after a hearing, notice of such hearing to be given to the person in charge of said real property at least ten days before such hearing. The findings and action of the City Council at such hearing shall be final. The foregoing Resolution is signed and approved by me this 12th day of March, 1946.
