RESOLUTION N0. 1+03
WHEREAS, it appears that the City of Newport Beach has made a request
that it be permitted to change its present connection with the marine section of
the Joint Outfall Sewer to a location known as Engineers station 21 570 by reason
of and during an emergency now confronting it,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANAHEIM
that on behalf of said City of Anaheim that it does hereby consent to the granting
of a permit to the City of Newport Beach to change its present connection with the
marine section of said Joint Oatfall Sewer to a location Down as Engineers
Station 215470 during the period of said emergency, provided:
1. That such permit shall not extend beyond one year from the date
of the adoption of this resolution;
2. That the City of Anaheim shall not be responsible for any expense
arising from the making and/or maintaining of such new connection;
3. That the City of Anaheim shall not be responsible for or liable for
any damages, injuries, or claims of damage and /or injury arising out of the
aaktng and /or maintaining of such connection or out of the making and /or maintain
ing of any pipeline of the City of Newport Beach to such connection; and
BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to
the City Council of the City of Santa Ana.
The foregoing resolution is approved and signed by me this 2nd day of
January, 19
