1943-1321RESOLUTION NO. 1321 RESCINDING RESOLUTION NO. 1266 WHEREAS, the City of Anaheim is the owner of that certain real property situated in the City of Anaheim, California, described as follows: Lot 4 in Block 2 of Tract No. 304 (Mills Park) as per map recorded in Book 14, Page 50, Miscellaneous Maps, Records of Orange County, California, and WHEREAS, by its Resolution No. 1263, adopted July 29, 1941, said City Council did offer said lot for sale, and WHEREAS, the successful bidder, H. C. Head, a married man, did agree to purchase said real property from the City of Anaheim for the sum of One Hundred Fifty -five ($155,00) Dollars, together with the further consideration of the agreement to surrender to the City Treasurer of the City of Anaheim his cancellat- ion of all outstanding 1911 Act Bonds and coupons being a lien upon said property, he being the highest bidder for the same, and did deposit the sum of Thirty -one ($31.00) Dollars, the same being twenty (20 percent of purchase price of said lot, and WHEREAS, the said H. C. Head has failed to comply with all provisions of said Resolution No. 1263, in that no further payment on purchase price of lot was made, and no surrender of outstanding 1911 Act Bonds and coupons being a lien upon said property was made. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANAHEIM that it does hereby rescind its Resolution No. 1266 to sell said property unto the said H. C. Head, a married man, and does hereby declare the twenty (20%) percent of purchase price forfeited to said City of Anaheim. In accordance therewith we are returning the un- recorded Corporation Grant Deed executed by The City of Anaheim, dated August 12, 1941, covering Lot 4 in Block 2 of Tract No. 304, Mills Park, as shown on a Map recorded in Book 14, page 50 of Miscellaneous Maps, records of Orange County, Calrornia, in favor of H. C. Head. Also we are enclosing our state- ment of charges showing the sure of $25.00 due this company. We trust the above is in order.
