ANAHEIM, CALIFORNIA TELEPHONE 3456 RESOLUTION NO. 42,5 WHER KAS, the City of Anaheim is the owner of treat cer— tain real property situated in the City of Anaheim, County of Orange, State of California, and more particularly described as Lot One (1) in Block Five (5) and Lot Nine (9) in Block One (1) all in Tract No. 304, Mills Park Tract, and WHEREAS, said lots have been acquired by said City by deed from the County Tax Collector of the County of Orange, State of California, in such cases made and provided, and WHEREAS, the City of Anaheim has no use for said property or any pare thereof for public purposes and the City Council of the City of Ananeim finds that it is for the benefit and best interests of said City that said property should be sold and conveyed unto private ownership in order that the same may again be placed upon the tax rolls of the City of Ananeim and County of Orange, and WHEREAS, the title to said real property appears to be clouded by reason of the fact that the last record owner of said property was a corporation whose right to do business has been suspended for the alleged reason that certain State franchise taxes had not been paid, and WHEREAS, it is the desire of the City of Anaheim that whoever purchases the interest of the City of Ananeim in said property shall clear the title thereof from any claim or supposed claim of said corporation, the cost of which is estimated to be approximately $240.00, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANAHEIM that it does hereby declare that it intends to and will at a regular meeting of said Council to be held on the =day of 1941, sell all of the right, title 1 1 2 3 forth: 4 5 6 7 8 9 10 11 12 13 14 15 ful performance, and upon failure of the bidder to pay the balance 10 of the purchase price at the time that the deed is delivered into 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 and interest of the City of Anaheim in and to the above described property upon the conditions and in the manner hereinafter set 1. Sealed bids will be accepted by the City Clerk for the purchase of said real property up to 8:00 o'clock P. M. of May 27, 1941, Upon the opening of said bids the same will be announced publicly at said meeting of the City Council, and thereupon any person present may increase the highest bid for said real property by an oral bid of at least ten (10%) per cent higher than the highest thereof, and thereupon the City Council will entertain additional oral bids. All bids, whether written or oral, shall be accompanied by cash or a certified or cashier's check upon a bank doing business in the State of California in an amount equal to at least 20% of the bid as a guarantee of faith- escrow as hereinafter set forth, such 20% deposit shall be for- feited to the City. In the event that no sealed bids are delivere to the City Clerk as above set forth, the City Council reserves the right nevertheless to entertain oral bids at said meeting. 2. Upon the City's selling its right, title and interest in said real property at such meeting 'the City will execute a grant deed conveying all of its right, :title and interes in said property unto the successful bidder, which deed will be delivered in escrow to the Orange County Title Company to be held by said company and not recorded until such time as the purchaser shall have secured from said corporation above referred to a deed of all the interest of said corporation in said property, or quiet title against said corporation. Upon securing such deed or quiet title judgment, the same shall be recorded concurrently with said deed of said City. In the event that said deed from such corporation or a judgment quieting title is not secured 2 11 and recorded within one year from the date of the City's deed, 2 I 3 escrow and thereupon the City's obligation to convey will be 41 terminated. The purchaser may obtain policy of title insurance then the City may at its discretion withdraw its deed from such 5 l at his own expense. The City Council reserves the right to reject any 7 and all bids offered. 8 4. The lowest acceptable bid for said property is the 9 sum of x'160.00, together with the agreement of the purchaser to 10 obtain a deed from said corporation or a judgment quieting title 11 against said corporation as above outlined. These two lots are 12 coffered for sale as one parcel. 13 5. The successful bidder shall Pay the full balance 14 of the purchase price to the City of Anaheim at the time of the 15 delivery of said deed to the Orange County Title Company, and in 16 the event he fails so to do the City shall not be obligated to 17 so deliver said deed, and if it is so delivered it may be with 18 drawn by the City at any time. 19 6.
