WHEREAS, the City of Anaheim is the owner of that certain real property described as Lot 28 in Block D of "Lorelei Tract" Lot 12 in Biock 2 of Tract 304, Lot 16 in Biock A of Tract 351, Lots 14 and 15 in Block 4 of Tract 422 and Lots 14, 15 and 16 in Block A of Tract 549, and the northerly 50 feet of Lot 9 of Tract 640, all of such lots are more particularly described hereafter, and WHEREAS, said lots have been acquired by said City by deed from the County Tax Collector of the County of Orange, State of California, in such cases made and provided, and by the pur- chase of quitclaim deeds from the former owners of the fee title, and FRIIS SCHUTZ ATTORNEYS AT LAW 402 -404 BANK OF AMERICA BLDG. ANAHEIM, CALIFORNIA TELEPHONE 3456 WHEREAS, the City of Anaheim has no use for said property or any part thereof for public purposes, and the City Council of the City of Anaheim finds that it is for the benefit and best interests of said City that the said property should be sold and conveyed into private ownership, in order that the same may again be placed upon the tax rolls of the City of Anaheim and the County of Orange, NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANAHEIM that it does hereby declare that it intends to and will atA t regular meeting of said council to be held on the 1 day of Ga 1941, sell the above described property manner hereinafter set forth: 1. Sealed bids will be accepted by the City Clerk for the purchase of said lots up to 8:00 o'clock P. M. of 1941. Upon the opening of said bids the same will be announced publicly, and thereupon any person present may increase the highest bid for any parcel by a bid at least ten (10) per cent upon the conditions and in the 1 11 1'higher than the highest thereof, and thereupon the City Council 2 ii will entertain additional oral bids. All bids, whether written 3�!or oral, shall be accompanied by cash or a certified check in an 4 1; amount equal to at least twenty (20 per cent of the bid as a 5 6 7 8 9 10jthat in the event said City is unable to convey title free and 11 clear of encumbrances,except restrictions, conditions and rights 12 13 �such failure to convey, and thereupon the purchase price or any 14 part thereof deposited by the bidder shall be returned to him by 15 I the City. 16 17 18 19 I 20 21 22 23 24 25 26 27 28 I 29 30 31 32 guarantee of faithful performance, and upon failure of the bidder to pay the balance of the purchase price at the time that a deed and policy of title insurance is issued to him, such 20% deposit shall be forfeited to the City. 2. This property is offered upon the understanding of way of record, that said City will be without liability for 3. With each deed the City will deliver to the purchaser a policy of title insurance to be issued by the Orange County Title Company in an amount not to exceed the purchase price, insuring the title to be in the purchaser free and clear of all encumbrances, except conditions, restrictions and rights of way of record. 4. The successful bidder shall pay the full balance of the purchase price at the time of the issuance of a deed and policy of title insurance to him, and in the event that he fails so to do, the City shall be without obligation to make delivery of deed. 7. In the event that identical bids are received, the first received shall receive priority. Bid forms may be obtained from the City Clerk. The foregoing resolution is approved and signed this 25th day of March, 1941.
