I PLAN OF THE CITY OF ANAHEIM COVERING THE FIRST PURCHASE OF TAX DELINQUENT LOTS Plan of the City of Anaheim, Orange County, California to return to the City Rolls, and to the County Tax Roils, Forty (40) lots be.ng all of the vacant tax deeded lots within the corporate limits of the City of Anaheim and being the property as listed in a proposed agreement dated May 1940 between the Board of Supervisors of Orange County Calif ornia, and the City Council of said City of Anaheim,California, 1, At the present time all such lots or parcels of property as shown in said agreement have been deeded to the State of California and are at present completely off of the assess- ment rolls of the City of Anaheim and the County of Orange, and will `produce NO TAX REVENUE until some effective plan is worked out to et the taxes and assessments brought up to date and the property back into the hands of private owners who will pay the current taxes and assessments as they become due, 2 These lots may be divided into two seperate roups, 15 lots being in Mills Park and the balance scattered through- out the City, The group of lots in Mills Park are all encumb- ered with 1911 Act Bonds now six years or more past due and the present amount, to settle such bonds thru the City Treasur- er's Office is considerable more than the present market value of such lots. To assure a sale of these lots the City will endeavor to have the present holders of these unpaid 1911 Act Bonds deposit same in an escrow, with a release clause covering the telease of each bond at a definite flat price. This is for the benefit of the new buyer at the sale and as part consideration, in connection with each sale the delin- quent 1911 Act Bond MUST be handed the City Treasurer to be cancelled. This plan, in «:;eneral, is as follows: (a) The City of Anaheim will purchase from the County of Orange, under Section 3897d of the Political Code and amend- ments thereto, the tax title now held by the State of Calif- ornia subject however, to the approval of the State Control- ler. At this point the State tax title and the City tax lien will be vested in the City of Anaheim. (b) The City of Anaheim then will offer to the record owner of each lot so purchased from the County a small sum of money in cash for a Quitclaim deed to such lots. At this point the City will have a good and marketable title to any such o for which it holds Quitclaim deeds. Thereupon the City will cancel all City taxes and penalties, to date, against such lots. (c) VPhere Quitclaim deeds to the lots involved in this sale are not secured quickl and at a very small cost, the City immediately will institute a court action to quiet title to such lots as are secured under the tax deed. (d) Upon the Court's decree, granting title to the City (it is expected that most parties will default by failing to answer the City's complaint) the City then will hold good title and then will cancel all taxes and penalties outstaand -st ing against such lots and then will sell such lots to the advantage of the City. (4/4i 2i Sheet i o0 1 Po 7 (e) Where it is found that some of these lots must be sold for a nominal sum, to compensate the new owner for settlement of a delinquent, 1911 Act Bond, then it is the intention of the City of Anaheim to make such sales at the Vest price obtainable on the present market, so as to re- turn all of these properties to the assessment rolls. Section 4 of Assembly Bill 1129, being Chapter No, 396 of the Statutes of 1935 is pertinent to this Plan and reads as follows:- "The facts constituting such necessity are as foliows:- Due to the depression which has existed in the past several years, many landowners have been unable to meet the taxes and assessments levied by the State, political subdivisions, agencies, reclamations drainage and levee districts, with the result that lands $lave been sold to the State and such taxing and assessment agencies. The heavy penalties assess- ed by law have made it impossible for the landowners to redeem their lands, hence thousands of acres of land (together with thousands of lots) have been sold for the non payment of such taxes and assessments, and deeds have been executed thereon to the State and such taxing and assessment agencies. That as long as such lands (or lots) remain State lands, the same are non assessable for tax or assessment purposes, and the tax and assessment burden becomes heavy upon the paying lands causing more delin- quencies and losses The legislature hereby declares that the welfare of the State requires that such lands (or lots) be placed in private ownership as promptly as possible so that such land (or lots) henceforth bear its just proportion of current taxation and assessments."
