72R-098 RESOLUTION NO. 72R-98 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ORDERING THE VACATION AND ABANDON- MENT OF AN EASEMENT FOR ROAD PURPOSES. (Near Miraloma Overcrossing) WHEREAS, the City Council of the City of Anaheim did on the 2nd day of November, 1971, declare by Resolution No. 71R-486 its intention to vacate and abandon that portion of certain real property herein described indicating its intention to reserve certain public utility easements therefrom, and did set the 7th day of December, 1971, for a public hearing thereon; and WHEREAS, on said 7th day of December, 1971, at 1:30 P.M. in the Council Chamber in the City Hall of the City of Anaheim, said public hearing was held; Resolution No. 7lR-525 was passed ordering vacation and abandonment of said property; and WHEREAS, it was decided at said December 7, 1971 meeting that it would be in the best interests Of the City of Anaheim to delay action on this matter until further information could be obtained concerning the title of said property, where- upon said Resolution No. 71R-525 was then rescinded by Resolution No. 7lR-526; and WHEREAS, the City Council finds from the additional information submitted at public hearing on March 21, 1972, that that portion of Anaheim Road, near Miraloma Overcrossing, herein- after described, is unnecessary for present or prospective road- way purposes, but that certain public utility easements should be reserved therein. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim: 1. That it finds that public hearing was properly held and that all notices were given and publications made as required by law. 2. That that certain portion of the real property toward which a request for vacation and abandonment was directed is not necessary for present or prospective roadway purposes and does hereby order that said portion, as herein set forth, be and it is hereby vacated, abandoned and closed to public use. That said portion of real property herein ordered vacated, abandoned and closed to public use is situated in the City of Anaheim, County of Orange, State of California, and is more particularly des- cribed as follows, to wit: That portion of Anaheim Road located in the City of Anaheim, County of Orange, State of California, lying within Lot 1 of Block 10 and Lot 11 of Block 9 of the Golden State Tract, as shown on a map recorded in Book 4, pages 66 and 67, Miscellaneous Maps, records of said Orange County, to be abandoned, described as follows: -1- 71- 3A ,(;""-- Beginning at the northwest corner of the land described in deed recorded September 27, 1971, in Book 9819, page 93 and 94, records of said Orange County; thence N 740 DO' 46" E, 184.46 feet to a point in a curve concave northeasterly and having a radius of 280 feet, a radial line bearing S 00 37' 57" E passes through said point; thence Northwesterly along said curve through a central angle of 90 47' 54" an arc distance of 47.88 feet; thence tangent to said curve N 800 50' 03" W, 55.16 feet to an intersection with a line parallel with and 20 feet north- erly of the centerline of Anaheim Road (now known as Miraloma Avenue); thence S 740 DO' 46" W, 116.92 feet along said parallel line to an intersection with the northwesterly prolongation of the westerly line of the land described in the aforementioned deed; thence S 500 15' 46" E, 48.41 feet along said prolongation to the point of beginning. Reserving therefrom an easement for public utility pur- poses including but not limited to sanitary sewer, water lines, storm drain and related facilities including reserving a public utility easement to County Sanitation District No. 2 of Orange County for sanitary sewer pur- poses comprised of a 30 inch trunk line and manhole over, under and across all that land lying northerly of the line above described, as having a bearing and dis- tance of S 740 DO' 46" W, 184.46 feet and the westerly prolongation thereof. 4. That the City Council finds that the following ease- ments should be reserved for public utility purposes: (1) Reservation of public utility easement including but not limited to a sanitary sewer, storm drain and water line purposes. (2) Reservation of a 20-foot easement for the exist- ing County Sanitation District No.2, 3D-inch trunk sewer and manhole located within the area proposed for abandonment. AND BE IT FURTHER RESOLVED that the City Clerk be and she is hereby authorized and directed to cause a certified copy of this Resolution and Order, attested by her unner the seal of the City of Anaheim, to be recorded in the Office of the County Recorder of Orange County, California.
