IN TEE MATTER OF ACQUISITION AND IMPROVEMENT DISTRICT NO. 3
OF THE CITY OF ANAHEIM
RESOLUTION FIXING TIME FOR HEARING UPON PROPOSED
ISSUANCE OF BONDS TO OBTAIN IMMEDIATE POSSESSION
WHEREAS, in a Resolution adopted by the City C of the
City of A on the 11th day of February, 1930, in the Matter o
Acquisition and Improvement District No. 3 of the City of Anaheim,
the acquisition of lands for the widening of Lincoln Avenue from
the Westerly line of North West Street to the Westerly boundary
line of the City of Anaheim to a uniform width of eighty (80)

as proposed in the Resolution of
Intention in the above entitled matter, adopted on the 14th'da.y
of January, 1930, was ordered, and Geo. F. Holden, Attorney of the
City of Anaheim and attorney for said Acquisition and Improvement
District No. 3, was ordered to bring an action for the condemnatic
of the nronerty necessary therefor, and to report to this City
Council the amounts of money required for the pur -Pose of obtainin€
immediate possession and use of the property so sought to be
acquired; and,
WHEREAS, the said Geo. F. Holden, Attorney, has reported to
this City Council that an action in eminent domain izas been filed
in the Superior Court of the State of California, in and for the
County of Orange, said action being entitled: "City of A a
Municipal C of the Sixth Class of the State of Californi
Plaintiff, vs. Orange C Title Company, a, Corporation, et al.,
Defendants ", being S Court case No. 26729, and that
proof was presented to the said Court of the amounts of money
required to secure immediate possession of the lands sought to be
condemned, and that the said Court made an Order directing the
deposit of money to secure - payment of compensation to defendants

in said action, and that the total amount required for deposit in
Court in order to obtain immediate possession of said property, as
set forth in said Order of Court, is the sum of Sixteen Thousand
Seven Hundred ($16,700.00) Dollars, and
WHEREAS, it is the intention of this City C to order
that bonds of said district be issued and sold for the purpose of
obtaining the necessary money to deposit in Court in order to
secure said immediate possession and use of said property,
NOW, THEREFORE, be it RESOLVED by the City Council of the Cit
of Anaheim as follows, to —wit:

time,
and the chambers
of
the
City
Council of the City of Anaheim, in the City Hall, in the City
of Anaheim, is the place, hereby fixed for a hearing upon
the issuance of bonds against the lands in the assessment district,
in Acquisition and Improvement District No. 3 of the City of
Anaheim, for the our- pose of obtaining the amounts required by
the Court, to —wit: amounts totaling the sum of Sixteen Thousand
Seven Hundred ($16,700.00) Dollars, in order that immediate
possession and use of the public ways sought to be acquired under
the proceedings in the above entitled matter may be had, and for
the purpose of furnishing an o- o to all persons owning 1
within the said assessment district, or otherwise interested, and
feeling aggrieved by an act or determination done or made in the
said proceeding, or claiming that any of the previous acts,
determinations or -proceedings are irregular, defective, erroneous
or faulty, or having any objections to offer, or any reason to
advance why bonds should not be issued in the amount above set
forth, for the nurnoses above set forth, to a.p -pea,r before this

City Council, and be heard upon any of the above mentioned matter .
Said bonds, so proposed to be issued in the sum of Sixteen Thousa I d

1' Seven Hundred (16,700.00) Dollars, will be issued under and in
,I
2� pursuance of the provisions of the "Acquisition and Improvement I
3 Act of 1925 and shall bear interest at the rate of six per cent
4 (0) per annum, payable semi — annually, and the aggregate princi—
5 pal of all bonds issued shall be paid and discharged within
8 twelve (12) years after the date of issuance, approximately
7 one —tenth (1 /10th) part of such aggregate principal to be payable
8 annually beginning three (3) years after date of issuance, all in
9 gold coin. A special fund for the payment of said bonds will
10 be constituted by the levy of special assessment taxes upon
11 the lands within the assessment district, according to the
12 assessed value of said lands, (exclusive of the improvements
13 thereon) and in accordance with the zones and percentages as
14 finally determined by this City Council on the 11th day of
15 February, 1930, in resolution passing upon protests and making
16 final determination as to boundaries, zones and percentages.
17 2. The City Clerk of the City of Anaheim shall prepare and
18 sign a Notice of the above :mentioned hearing, and shall cause
19 the same to be published by at least two insertions in the
20 newspaper designated in said Resolution of Intention, and a copy
21 of said Notice shall be posted, and kept posted for at least two
2.2 days on or near the chamber door of this City Council.

24 The foregoing Resolution Fixing Time for Hearing upon Propose
25 Issuance of Bonds to Obtain Immediate Possession is hereby approve
