01/14/1926-062IN THE NATTER OF PA VING OAK STREET RESOLUTION OF INTENTION NO.194 A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITY OF ANAHEIM DECLARING ITS INTENTION TO ORDER THE PAVING OF THE ROADW*Y OF OAK STREET IN SAID CITY. RESOLVED BY THE BOARD OF TRUSTEES OF THE CITY OF ANAHEIM: Section 1: That the public interest and convenience require and that it is the intention of the Board of Trustees of the City of Anaheim to order the following described street work to be done in said city, to -rit: That the roadway of Oak Street, from the westerly property line of South Lemon Street to the easterly property line of South Palm Street (excepting therefrom street intersections already paved) be graded to the official grade and paved with asphaltic concrete pavement six (6) inches thick and nominally thirty two (32) feet in:..width between curbs; that standard Portland cement concrete curbs and sidewalks be constructed or reconstructed to the official grade along both sides of said roadway, where such curbs and sidewalks have not been constructed or have become broken; and that driveway crossings and approaches along and adjoining said roadway, where such crossings and approaches have not been constructed or have become broken, be graded to the official grade and paved of isepaved with concrete six (6) inches thick and nongistigg of a mixture of 1 part Portland cement, 2 parts sand and 3 parts gravel or crushed rock AND WHEREAS, said contemplated work and improvement, in the opinion of the Board of Trustees, is of more than local or ordinary public benefit, said Board hereby wakes the expenseof said Work and improvement chargeable upon a district within taid City of Anaheim, Which district said Board hereby declares to be the dis- trict benefited by said work and improvement and to be assessed to pay the gusts and expenses thereof, which said district includes the following lots, portions of lots or parcels of land in said City, to -wit : - Lots 2 29 and 33, the southerly 75 feet of Lots 3,4,9 and 10, the northerly 75 feet of Lots,, 19,20,25,26,31 and 32, Langenberger Tract, as per map recorded in Book 1, Pages 550 and 551, Miscellaneous Records of Los Angeles County, California; and The southerly 75 feet of the westerly 110 feet of Vineyard Lot E -5, as per map recorded in Book 4 of Deeds, Page 630, Records of Los Angeles County. The boundaries of said district are as shown on a map thereof marked and designated "Diagram showing property to be assessed for improvements on Oak Street, pursuant to Resolution of Intention No. 194 of the Board of Trustees of the City of Anaheim, California," which said map is on file in the office of the City Engineer of said City. -1- SECTION 2: Said work shall be done in accordance with the plan, profile and specificationstherefor, which plan and profile was adopted by the Board of Trustees of the City of Anaheim by resolution, on the Mth day of September, 1925, and is marked and designated "Paving Plan, Oak Street, Street Improvement No. 47," and is on file in the office of the City Engineer of said City; and which specifications are on file in the office of the City Clerk of said City and are entitled and designated as follows, to -wit: "General Specifications No. 36, Series of 1925, For Public Work, City of Anaheim. California," approved Ladd adopted by the of Trustees on the 27th day of August, 1925; and "Specifications No. 34, Series of 1924, For the Construction of Asphaltic Concrete Pavement, City of Anaheim, California," approved and adopted by said Board ofTrustees on the 25th day of June, 1925. Also reference is hereby made to Ordinance No. 404 of said City, for specifications governing cement curb, sidewalk and driveway construction. SECTION 3. Notice is hereby given that on Thursday, the 11th day of February „ 1926, at the hour of eight o'clock P.M., at the Council Chamber of the Board of Trustees of the pity of Anaheim. in the City Hall at 204 East Center Street in said City, any and all persons having objections to the proposed work or improvement may ::appear before said Board or Trustees and show cause why said proposed work and improvement should not be carried out in accordance with this resolution; provided, all such protests must be in writing and must be delivered to the City Clerk before the hour set for hearing objections. SECTION 4: That said Board of Trustees hereby further determines that serial bonds shall be issued to represent assessments of $25.00 or over for the cost and expenses ox said work and improvement; that said serial bonds shall extend over a period of nine years from the second day of January next succeeding the fifteenth day of the next November following their date, and an even annual proportion of the principal sum thereof shall be payable, by coupon, on the 2nd dqy of January of each year following the fifteenth day of the next November after their date,until the whole is paid, and the interest shall be paid: - serf.- annually, by coupon, on the 2nd days of January and July. respectively, of each year, at the rate of seven percent per annum on all sums unpaid, until the whole of said principal and interest are paid. SECTION 5: The Anaheim Bulletin is hereby designated as the newspaper printed, published and circulated in said City in which this resolution shall be published, and the City Clerk of the City of Anaheim is hereby directed to publish this resolution by two successive insertions in said newspaper. The Street Superintendent shall immediately cause to be conspicuously posted along the line of said contemplated work or improvement and in front of all the property liable to be assessed, notice of the passage of this Resolution of Intention in the manner and form required by Law. All of the herein proposed work and improvement shall be done and said serial bonds shall be issued under and in pursuance of an Act of the Legislature of the State of California, desig- nated the "Improvement Act of 1911," and all acts amendatory thereof. -2- The foregoing Resolution of Intention' is signed, approved and attested by me this day of _ 1926.
