12/01/1925-016IN THE MATTER O PAVING NORTH AND SOUTH OLIVE STREE IN THE CITY OF ANAHEIM, CALIFORNIA,. ** ** * * * ** ** * %* * * * * * * * * * * * * * * % * *** RESOLUTION OF INTENTION NO. 191 A RESOLUTION OF THE BOARD OF TRUSTEES OF THE CITE' OF ANAHEIM DECLARING ITS INTENTION TO ORDER THE PAVING OF THE ROADWAY OF A PORTION OF NORTH AND SOUTH OLIVE STREETS IN SAID CITY. RESOLVED BY THE BOARD OF TRUSTEES OF THE CITY OF ANAHEIM: SECTION 1: That the public interest and convenience require and that it is the intention of the Boar f Trustees of the City of Anaheim to order the following de cribed street work to be done in said city, to -wit: That the roadway of South and North Olive Streets, from the northerly line of East Santa Ana Street to the northerly line of East North Street (excepting therefrom the easterly half ofthat portion of said roadway extending from the southerly line of East Broadway to a line parallel therewith and distant 321.55 feet southerly therefrom, also all street intersections already paved) be graded to the official g3Eade and axed with asphaltic concrete pavement five (5) inches thick and �arying from thirty seven (37) feet to thirty nine and six tenths (39.6) feevin width between curbs, with 24 inch by sde inch corrugated iron odlverts across said roadway at each of East Alberta Street, and 20 inch by 5 -1/8 inch corrugated iron culverts across said roadway at each side of East North Street; that standard Portland cement concrete curbs be constructedto the official grade where mt already constructed along said roadway to be improved; and that alley and driveway crossings and approaches adjoining said roadway to be improved, where such crossings or approaches have not been constructed or have become broken, be graded to the official grade and paved or repaved with concrete six (6) inches thick anonsisting of a mixture of 1 part Portland cement, 2 parts 6and and 3 parts gravel or crushed rock. AND WHEREAS, said contemplated work and improvement, in the opinion of the Board of Trustees, Ss of more than l6cal or ordinary public benefit, said Board hereby makes the expense of said work and improvement chargeable upon a district within said City of Anaheim, which district said Board hereby declares to be the district benefited by said work and im- provement and to be assessed on the front foot plan to pay all.. costs and expenses thereof, except such portion as shall be paid fpr by the City out of its treasury, which said city's portion includes all work on all main and subdivision street crossings and the westerly half of said roadway at the Albert& street termination. -1- The property to be assessed includes all or w4part of each of the parcels of land, f'6-wit.- far �.ae.id improvement following lots or Lots 1 to 17 inclusive, Block A. Monte Vista Tract, as per map recorded in Book 13, Page 51, Miscellaneous Maps, Records of Orange County; The boundaries of said district are as shown on maps marked and designated "Diagram showing roperty to be assessed for improvements on North (or South Olive Street, Pursuant to Resolution of Intention No. 191 of the Board of Trustees of the City of Anaheim, California," on file in the office of the City Engineer of said City. I Said work shall 7;e done in acdFordanoe with the plans and specifications therefor, which said plans were approved and adopted by the Board of Trustees of said City on the 24th. day of September, 1925, and are marked and designated "Pacing Plan, South Olive Street, Sheet No, 1" and "Paving Plan, North Olive Street, Sheets Nos. 2,3 and 4, Street Improvement Duo, 46," and are on file in the office of the City Engineer of said-City. and which said specifoations were approved and adopted by said Board of Trustees on the 25tbAky of June, 1925, and are entitled and designated "Specifications No, 34, Series of 1924, For the Construction of Asphaltic Concrete Pavement, City of Anaheim,California," and are on file in the office of the City Clerk of said City Also, reference is hereby m#Aa to Ordinance No, 404 of said City for specifications governing cement curb, sidewalk and driveway construction, SECTION 2= Notice is hereby given that on Thursday the 24th.day of Deoember, 1925, at the hour of eight otcl&ck PM., at the Council Chamber of the Board of Trustees of the City of Anaheim, in the City Hall, at No, 204 lust Center Street inreaid City, any and all persons having objections to the proposed work or improvements may appear before said Board of Trustees and show pause why such proposed work and improvement should not be carried out in accordance with this resolution; provided, that all such protests must be in writing and must be delivered to the City Clerk before the hour set for the hearing of objections, -3- SECTION 3; That said Board of Trustees hereby further determines that serial bonds shall be issued to represent assessments of $25.00 or over for the cost and expenses of said work and improvement; that said serial bonds shall extend over a period of nine years from the second day of January next succeeding the fifteenth day of the next November following their date, and an even annual proportion of the principal sum thereof shall be payable, by coupon, on the 2nd day of January every year after the fifteenth day of the next November following their date until the whole is paid, and the interest shall be paid semi - annually by coupon, on the 2nd days of January and July respectively, of each year, at the rate of seven percent per annum on all sums unpaid, until the whole of said principal and interest are paid. SECTION 4t The Anaheim Bulletin is hereby designated as the newspaper printed, published and circulated in said'City in which this resolution shall be published, and the City Clerk of the City of Anaheim is hereby directed to publish this resolution by two successive insertions in said newspaper. The Street Superintendent shall imm6dis,ttly cause to be conspicuously posted altng the line of said contemplated work or improvement and in front of all property liable to be assessed, notice of the passage of this Resolution of Intention, in the manner and form required by Law. All of the herein proposed work and improvement shall be done and said, serialnbonds shall be issued under and in Pursuance of an Act of the Legislature of the State of California, designated the "Improvement Act of 1911,N and all acts ameddatory thereof.
