72R-446 RESOLUTION NO. 72R-446 ~. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 2421. WHEREAS, after a request for variance by STANDARD OIL OF CALIFORNIA, owner, and AMERICAN PE~T SERVICE, agent, was received, a public hearing before the Planning Commission of the City of Anaheim was held upon due and proper notice as a result of which Variance No. 2421 was denied covering the following described property: That part of Lot 3 of Anaheim Extension, as shown on a Map of Survey made by William Hamel and filed in the office of the County Recorder of Los Angeles County, a copy of which is recorded in BOok 3, Page 163 and following entitled "Los Angeles County Maps" in the office of the County Recorder, Orange County, California, described as follows: Beginning at the Northeast corner of said Lot 3 being the point of intersection of the center line of La Palma Avenue formerly North Street with the center line of Placentia Avenue, as shown on said Map; thence South 00 07' 30" West along the center line of said Placentia Avenue, 200 feet to the Northeast corner of the land described in the deed to Anaheim Community Congregationaal Church, a corporation, recorded June 9, 1959, in Book 4750, page 96 of Official Records; thence North 890 51' 30" West along the North line of said church land, 203 feet; thence North 00 07' 30" East parallel to the center line of said Placentia Avenue 200 feet, to the center line of said La Palma Avenue; thence South 890 51' 30" East, 203 feet to the point of beginning. WHEREAS, thereafter, within the time prescribed by law an interested party or the City Council on its own motion caused the review of said Planning Commission action at a public hearing noticed and held as prescribed by law and as a result thereof the City Council does hereby make the following findings: 1. That there are special circumstances applicable to the property, including size, shape, topography, location or surroundings, which do not apply to other property under identical zoning classifica- tion in the vicinity. 2. That, because of special circumstances shown in (1) above, strict application of the zoning code deprives the property of privileges enjoyed by other property under identical zoning classification in the vicinity. ,,-- NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted, permitting the construction of two lighter box signs and four canopy signs in conjunction with an existing free-standing sign on the property hereinbefore described with waivers of the following sections of the Anaheim Municipal Code: -1- SECTION l8.62.090(B-l) Minimum distance between free- standing signs. (300 feet required; 19 feet proposed) ~ SECTION l8.62.090(B-l) Maximum number of free-standing signs. (7 proposed; 1 permitted) Minimum distance to a property line. (56 feet required; 51 feet proposed) Minimum sign height. (8 feet required; 6 1/2 feet proposed) SECTION 18.62.090(B-S) SECTION 18.62.090(B-2) That said variance be granted subject to the following condition: That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim, marked Exhibits Nos. 1, 2 and 3. BE IT FURTHER RESOLVED that the City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owner, its successors or assigns, to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein. THE FOREGOING RESOLUTION is approved and signed by me this 3rd day of October, 1972.
