72R-444 r- ~' /""""", .- RESOLUTION NO. 72R-444 A RESOLUTION OF THE CITY CQUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 2416. WHEREAS, after a request for variance by STANDARD OIL OF CALIFORNIA, owner, and AMERICAN PERMIT SERVICE, agent, was received, a public hearing before the Planning Commission of the City of Anaheim was held upon due and proper notice as a result of which Variance No. 2416 was denied covering the following described property: That portion of the West 5.13 acres of the North half of the Northwest quarter of the Northeast quarter of section 24, Township 4 South, Range II West, San Bernardino Base and Meridian, in the Rancho Los Coyotes, City of Anaheim, described as follows: Beginning at the Northwest corner of the Northeast quarter of said Section 24 and running thence South 00 12' 35" West 328.90 feet along the West line of said Northeast quarter; thence South 890 59' 42" East 338.71 feet to the South- east corner of the land conveyed to Gordon L. Hodge, a married man, by deed to him recorded August 1, 1962, in Book 6216, page 580, Official Records; thence North 00 12' 35" East 329.00 feet along the Easterly boundary line of said land granted to Gordon L. Hodge, a married man, to the Northeast corner of the land conveyed to Elmer L. Beeson and wife by deed recorded May l8, 1948, in Book 1638, page 150, Official Records; thence South 890 59' l5" West 338.71 feet along the Northerly line of said Northeast quarter to the point of beginning. EXCEPTING the Southerly 130 feet of the Easterly l46 feet. WHEREAS, thereafter, within the time prescribed by law an interested party or the City Council on its own motion caused the review of said Planning Commission action at a public hear- ing noticed and held as prescribed by law and as a result thereof the City Council does hereby make the following findings: l. That there are special circumstances applicable to the property, including size, shape, topography, location or surroundings, which do not apply to other property under identical zoning classifica- tion in the vicinity. 2. That, because of special circumstances shown in (1) above, strict application of the zoning code deprives the property of privileges enjoyed by other property under identical zoning classifica- tion in the vicinity. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted, permitting the construction of two lighter box signs and two canopy signs in conjunction with an existin~ free-standing sign on the property hereinbefore described with wa1vers of the following sections of the Anaheim Municipal Code: -1- 4 '~""', SECTION 18.62.090(B-l) Minimum distance between free- standing signs. (300 feet required; 19 feet proposed) Maximum number of free-standing signs. (7 signs proposed; 1 permitted) r SECTION 18.62.090(B-l) SECTION 18.62.090(B-2) Minimum sign height. (8 feet required; 6 1/2 feet proposed) Minimum distance to adjacent property line. (60 feet required; 46 feet proposed) SECTION 18.62.090(B-S) That said variance be granted subject to the following condition: That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim, marked Exhibits Nos. 1, 2 and 3. BE IT FURTHER RESOLVED that the City Counci.l hereby reserves the right to revoke such variance permi~ !or good cause or failure of said owner, its successors or assigns, to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term pre- scribed by the Anaheirn Municipal Code unless otherwise specified herein.
