72R-440 ," RESOLUTION NO. 7i2R-440 r''' A RESOLUTION OF THE CITyqoUNCIL OF THE CITY OF ANAHEIM GRANTING VARI~CE NO. 2410. WHEREAS, after a request f10r variance by STANDARD OIL OF CALIPORNIA, owner, and AMERICAN PjERMIT SERVICE, agent, was received, a public hearing before ~e Plannin9 Commission of the City of Anaheim was held upon due ~d proper notice as a result of which Variance No. 2410 was deni~d covering the following described property; That portion of Rancho San Juan Cajon de Santa Ana, described as follows: The Westerly 190 feet of the Squtherly 200 feet of the Southwest One-Quarter of the Squthwest One-Quarter of the Southwest One-Quarter of S~ction 5, Township 4 South, Range 10 West, S.B.B. & 1M., EXCEPTING therefrorn that portion thereof described as follows: Beginning at a point in the So~therly line of said land distant 190 feet East of the Squthwest corner thereof; thence Northerly along the Eas~erly line of said land 160 feet to the true point of beginning; thence Northerly along said Easterly line 40 fe~t; thence Westerly along the Northerly line of said land 40 feet; thence South- easterly in a direct line to the true point of beginning, SUBJECT to easements of record for public road purposes over the Southerly 50 feet and the Westerly 40 feet of said land. WHEREAS, thereafter, wi th:lm the time prescribed by law an interested party or the City Council on its own motion caused the review of said Planning Commission action at a public hearing noticed and held as prescribed by law and as a result thereof the City Council does hereby rnake the following findings: 1. That there are special circumstances applicable to the property, including size, shape, topography, location or surroundings, which do not apply to other property under identical zoning classifica- tion in the vicinity. ,~\ 2. That, because of special oircumstances shown in (1) above, strict application of the zoning oode deprives the property of privileges enjoyed by other property under identical zoning classifica- tion in the vicinity. NOW, THEREFORE, BE IT RESOLVED by the C! ty Council of the City of Anaheirn, that a conditional zoning variance be, and the same is hereby granted permitting the construction of two lighter box signs in conjunction with an existing free-standing sign on the property hereinbefore described with waivers of the following sections of the Anaheim Municipal Code: SECTION 18.62.090(B-l) Minimum distance between free- stand~ng signs (300 feet required; 60 feet proposed) -1- ~ I 1,.....\ WPH : Jew -. - 1 SECTION l8.62.090(B-l) Maximum number of free-standing signs. That the owner of s~ject property shall deed to the City of Anaheim a strip of land!iiO feet in width frorn the centerline of the street along Broolhurst Street with a 25-foot radius corner return, and a strip of land 53 feet in width from the centerline of the street along l[.a Palma Avenue, for street widening purposes. 2. That subject property shall be developed substan- tially in conformance with plans an~ specifications on file with the City of Anaheim, marked Exhibi t$ Nos. 1 and 2. BE IT FURTHER RESOLVED that the City CoUncil hereby reserves the right to revoke such variance pe~it for good cause or failure of said owner, its successors or usigns, to comply with the Anaheim Municipal Code and regulations and the conditions herein.
