72R-439 RESOLUTION NO. 72R-439 r A RESOLUTION OP THE CITY CQUNCIL OP THE CITY OF ANAHEIM GRANTING VARIANdE NO. 2409. WHEREAS, after a request fqr variance by STANDARD OIL OF CALIFORNIA, owner, and AMERICAN P~RMIT SERVICE, agent, was received, a public hearing before the Planning Commission of the City of Anaheirn was held upon due and proper notice as a result of which Variance No. 2409 was denied covering the following described property: PARCEL 1: Beginning at the southeast corner of Vineyard Lot 0-6 as per rnap recorded in book 4 p~ges 629 and 630 of Deeds, in the office of the county recdrder of Los Angeles County; thence westerly 160.25 ~et along the southerly line of said Lot 0-6; thence northerly 165.00 feet para- llel with the easterly line of ~aid Lot; thence easterly 125.00 feet, parallel with said southerly line; thence northerly 15 feet parallel with said easterly line of said lot; thence easterly 35.25 feet, parallel with said southerly line; thence southerly 180.00 feet along said easterly line to the point of beginning. EXCEPT the easterly 20.25 feet thereof lying within Harbor Boulevard. ALSO EXCEPT the southerly 20.00 feet thereof lying within Lincoln Avenue. PARCEL 2: Beginning at the southeast corne,r of Vineyard Lot 0-6, as per map recorded in book 4 pases 629 and 630 of Deeds, in the office of the county recQrder of said Los Angeles County; thence westerly 160.25 feet along the southerly line of said Lot 0-6 to the true point of beginning; thence westerly 10.00 feet along said southerly line of said Lot 0-6; thence northerly 4:0.00 feet parallel with the easterly line of said lot; thence easterly 10.00 feet parallel with said southerly line; thence southerly 40.00 feet parallel with said easterly line to the point of beginning. EXCEPT the southerly 20.00 feet thereof lying within Lincoln Avenue. WHEREAS, thereafter, wi thin the time prescribed by law an interested party or the City Council on its own motion caused the review of said Planning commission action at a public hearing noticed and held as prescribed by law and asa result thereof the City Council does hereby make the following findings: ,"'-' 1. That there are special circumstances applicable to the property, including size, shape, topography, location or surroundings, which do not apply to other property under identical zoning classification in the vicinity." 2. That, because of special circumstances shown in (1) above, strict application of the zoning code deprives the property of privileges enjoyed by -l- ~ ,r' FAL:kw other property under identical zoning classifica- tion in the vicinity. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditiona,1 zoning variance be, and the same 1s hereby, granted permitting the construction of three lighter box aigns aad four canopy signs in conjunction with an exiating aonument aign on the propert~ hereinbefore described with waivers of the following section~of the Anaheirn Municipal Code: SECTION 18.62.090(B-l) Minirnum distance between free- standing signs. (300 feet required; 3 feet proposed) Maxirnum number of free-standing signs. (7 proposed; 1 permitted) Minirnum distance to a property line. (52 feet required~ 43 feet proposed) Minimum sign height. (8 feet required; 6 1/2 feet proposed) That said variance be granted subject to the following condition: SECTION 18.62.090 (B-1) SECTION 18.62.090(B-5) SECTION 18.62.090(B-2) That subject property shall be developed substantially in conformance with plans and specifications on file with the City of Anaheim, rnarked Exhibits Nos. 1, 2 and 3. BE IT FURTHER RESOLVED that the City COUJ1cil hereby reserves the right to revoke such variance permit for good cause or failure of said owner, its successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise speci- fied herein.
