72R-417 HESOLUTION NO. 72R-417 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF M~AHEIM GRANTING VARIANCE NO. 2429. #~ WHEREAS, after a request for variance by KEITH NO SACK and W. L. HOHENSEE, et al., Owners, was received, a public hearing before the Planning Commission of the City of Anaheim was held upon due and proper notice as a result of which Variance No. 2429 was granted, covering the following described property: Parcell. That portion of Lot 28 of Anaheim Extension, in the City of Anaheim, County of Orange, State of California, as shown on a map of survey made by William Hammel and filed in the office of the County Recorder of Los Angeles County, California, a copy of which is shown in Book 3, page 163 et seg., entitled "Los Angeles County Maps", records of said Orange County, included within the following described lines: Beginning at the intersection of the center line of Vermont Street, formerly Broad Street, with the center line of Harbor Boulevard, formerly Palm Street, as shown on a map filed in Book 26, page 36 of Record of Surveys, in the office of the County Recorder of said Orange County; thence South 150 48' 00" East 183.00 feet along said center line to the true point of beginning; thence South 150 48' 00" East 179.00 feeti thence South 740 27' 30" West 272.25 feet parallel with said center line of Vermont Street; thence South ISO 48' 00" East 80.00 feet; thence South 740 27' 30" West to the Southeast corner of the land described in the deed to William L. ",- That portion of Lot 28 of Anaheim Extension, in the City of Anaheim, County of Orange, State of California, as shown on a map of survey made by William Hammel and filed in the Office of the County Recorder of Los Angeles County, California, a copy of which is shown in Book 3, page 163 et seq., entitled "Los Angeles County Maps", records of said Orange County, described as follows: The Southerly 16.5 feet of the Northerly one-half of the Easterly 1 acre of the Westerly 5 acres of the following described land: Beginning at the Northeasterly corner of said Lot 28; thence Westerly along the Northerly line of said Lot, 786.90 feet to a point 378.75 feet Easterly of the North- westerly corner of said Lot 28; thence Southerly, parallel to the Westerly line of said Lot, 442 feet; thence Easterly parallel to the Northerly line of said Lot, 786.90 feet to a point on the Easterly line of said lot; thence Northerly along said Easterly line 442 feet to the point of beginning. EXCEPTING FROM said Easterly 1 acre that portion occupied by Vermont Avenue, formerly Broad Street. WHEREAS, thereafter, within the time prescribed by law an interested party or the City Council on its own motion caused the review of said Planning Commission action at a public hearing noticed and held as prescribed by law and as a result thereof the City Council does hereby make the following findings: 1. That there are special circumstances applicable to the property, including size, shape, t~pography, location or surroundings, which do not apply to other property under identical zoning classifica- tion in the vicinity. 2. That, because of special circumstances shown in (1) above, strict application of the zoning code deprives the property of privileges enjoyed by other property under identical zoning classifica- tion in the vicinity. iWW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted permitting the establishment of a 7s-unit two-story motel with manager's suite in addition to a 4000-square foot restaurant on the property hereinbefore described with waivers of the following sections of the Anaheim Municipal Code: Section 18.37.030(b-2) Required building setback from a single family residential zone. (48 feet required; 5 and 10 feet proposed) .<;-#--... Section l8.37.030(h) Required 6-foot solid masonry zone boundary wall. (Central 20% of property or no closer than 71.6 feet on the southerly property line required, 33 feet to the property line proposed) ,.)\- That said variance is granted subject to the following conditions: I. That this variance is granted subject to the completion of Reclassification No. 72-73-20. 2. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibits Nos. I, 2 and 3. BE IT FURTHER RESOLVED that the City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owners, their heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise speci- fied herein.
