RESOLUTION NO. 72R-416 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMEND- ED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearinq in Reclassification Proceed- ings No. 72-73-29 to consider an amendment to Title 18 of the Anaheim Munic~pal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter men- tioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing, the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Plan- ning Commission the City Council did fix the 19th day of September, 19 72, as the time, and the City Council Cham6er'i in the C~ty Harr-of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal COde,' and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incorpora- tion thereof in the zone or zones hereinafter set forth, and did give notice thereof in the manner and form provided in said Title l8 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recom- mendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. _._,~ NOW, THEREFORE. BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following des- cribed property, situated in the City of Anaheim, County of Orange, State of California, to wit: -l- 72-73-20 Parcell. .e~ That portion of Lot 28 of Anaheim Extension, in the City of Anaheim, County of Orange, State of California, as shown on a map of survey made by William Hammel and filed ll1 the office of the County Recorder of Los Angeles County, California, a copy of which is shown in Book 3, page 163 et seq., entitled "Los Angeles County Maps", records of said Orange County, included within the following described lines: Beginning at the intersection of the center line of Vermont Street, formerly Broad Street, with the center line of Harbor Boulevard, formerly Palm Street, as shown on a map filed in Book 26, page 36 of Record of Surveys, in the office of the County Recorder of said Orange County; thence South ISo 48' 00" East 183.00 feet along said center line to the true point of beginning; thence South lSo 48' 00" East 179.00 feet; thence South 740 27' 30" West 272.25 feet parallel with said center line of Vermont Street; thence South 150 48' 00" East 80.00 feet; thence South 740 27' 30" West to the Southeast corner of the land described in the deed to William L. Hohensee, et al., recorded July 5, 1946, in Book 1424, page 282, Official Records; thence North 150 37' 25" West 221.00 feet along the East line of said land; thence North 740 27' 30" East 9.54 feet to a point South 740 27' 30" West 284.75 feet from said center line of Harbor Boulevard; thence North 150 48' 00" East 38 feet; thence North 740 27' 30" East 284.75 feet to the true point of beginning. That portion of Lot 28 of Anaheim Extension, in the City of Anaheim, County of Orange, State of California, as shown on a map of survey made by William Hammel and filed in the office of County Recorder of Los Angeles, Calif- ornia, a copy of which is shown in Book 3, page 163 et seq., entitled "Los Angeles County Naps", records of said Orange County, described as follows: The Southerly one-half of the Easterly 1 acre of the Westerly 5 acres of the following described land: Beginning at the Northeasterly corner of said Lot 28; thence Westerly, along the Northerly line of said lot, 786.90 feet to a point 378.75 feet Easterly of the North- westerly corner of said Lot 28; thence Southerly parallel to the Westerly line of said Lot 442 feet; thence Easterly parallel to the Northerly line of said Lot 786.90 feet to a point on the Easterly line of said Lot; thence Northerly along said Easterly line 442 feet to the point of begin- ning. EXCEPTING FROM said Easterly one acre that portion occupied by Vermont Avenue, formerly Broad Street. ~ Parcel 3. That portion of Lot 28 of Anaheim Extension, in the City of Anaheiln, County of Orange, State of California, as shown on a map of survey made by William Hammel and filed in the Office of the County Recorder of Los Angeles County, -2- California, a copy of which is shown in Book 3, page 163 et seq., entitled "Los Angeles County Maps", records of said Orange County, described as follows: - The Southerly 16.5 feet of the Northerly one-half of the Easterly I acre of the Westerly 5 acres of the following described land: Beginning at the Northeasterly corner of said Lot 28; thence Westerly along the Northerly line of said Lot, 786.90 feet to a point 378.75 feet Easterly of the Northwesterly corner of said Lot 28; thence Southerly, parallel to the Westerly line of said Lot, 442 feet; thence Easterly parallel to the Northerly line of said Lot, 786.90 feet to a point on the Easterly line of said lot; thence Northerly along said Easterly line 442 feet to the point of beginning. EXCEPTING FROM said Easterly 1 acre that portion occupied by Vermont Avenue, formerly Broad Street. be excluded from R-A, AGRICULTURAL ZONE, and incorporated in C-R, COMMERCIAL-RECREATIONAL ZONE, subject to the following conditions: 1. That the owners of subject property shall deed to the City of Anaheim a strip of land 53 feet in width from the centerline of the street along Harbor Boulevard for street widening purposes. 2. That all engineering requirements of the City of Anaheim along Harbor Boulevard, including preparation of improvement plans and installation of all improvements, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer; that street lighting facilities along Harbor Boulevard shall be installed as required by the Director of Public Utilities and in accordance with standard plans and specifications on file in the office of the Director of Public Utilities; and that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of the above mentioned requirements. 3. That the owners of SUbject property shall pay to the City of Anaheim the sum of'15 cents per front foot along Harbor Boulevard for tree planting purposes. 4. That trash storage areas shall be provided in accordance with approved plaDs on file with the office of the Director of Public Works. - S. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. 6. That all air conditioning facilities shall be properly shielded from view and the sound buffered from adjacent properties. 7. That a parcel map to record the approved division of subject property be submitted to and approved by the City of Anaheim and then be recorded in the Office of the Orange County Recorder prior to the issuance of a building permit. -3- 8. That subject property shall be served by underground utilities. 9. That subject property shall be developed substantially in conformance with plans and specifications on file with the City of Anaheim marked Exhibits Nos. 1, 2 and 3. IO. That ordinances reclassifying the property shall be adopted as each parcel is ready to comply with conditions pertaining to such parcel provided, however, that the word "parcel" shall mean presently existing parcels of record and any parcel or parcels approved by the City Council of a lot split. 11. That drainage of subject property shall be disposed of in a manner that is satisfactory to the City Engineer. 12. Prior to the introduction of an ordinance rezoning subject property, Conditions Nos. 1, 2 and 3, above mentioned, shall be completed. The provisions or rights granted by this resolution shall become null and void by action of the City Council unless said conditions are complied with within one year from the date hereof or such further time as the City Council may grant. 13. That Conditions Nos. 4: 5, 6, 8, 9, and 11, above mentioned, shall be compliec with prior to final building and zoning inspections. BE IT FURTlillR RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
