72R-412 RESOLUTION NO. 72R-4l2 ~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMEND- ED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Plannin9 Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 72-73-17 to consider an amendment to Title IS of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter men- tioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing, the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Plan- ning Commission the City Council did fix the 19th day of seiteBlber, 19~, as the time, and the City Council Cham6eri in the Ci y Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal COde,' and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incorpora- tion thereof in the zone or zones hereinafter set forth, and did 9ive notice thereof in the manner and form provided in said Title l8 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findin9s and recom- mendation; and .,-~ WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following des- cribed property, situated in the City of Anaheim, County of Orange, State of California, to wit: -l- 72-73-17 , .-~......, Beginning at a point in the South boundary of Tract No. 2350, as shown on map recorded in Book 69, pages 45 to 47, inclusive, of Miscellaneous Maps, records of said County, distant South 890 58' 14" East 53.00 feet from the centerline of State College Boulevard (formerly Placentia Avenue), said point being a point in the easterly line of said State College Boulevard, 106 feet wide; thence along said South tract boundary South 890 58' 14" East 661.12 feet to a point in the West boundary of Tract No. 6809, as shown on map re- corded in Book 266, pages 15 to 19, inclusive, of Miscellaneous Maps, records of said County; thence along said West tract boundary South O. OS' 15" West 617.80 feet to a point in the northerly sideline of Wagner Avenue, 90.00 feet wide, thence along said northerly sideline South 890 59' 32" West 583.07 feet to the beginning of a tangent curve concave Northeast- erly, having a radius of 25.00 feet, and being tangent at its terminus with the aforesaid East line of State College Boulevard; thence Westerly, Northwesterly and Northerly along said curve 39.31 feet and through a central angle of 900 05' 43"; thence tangent to said curve North 00 OS' IS" East along said East line of State College Boulevard s93.ls feet to the point of beginning. be excluded from R-A, AGRICULTURAL ZONE, and incorporated in R-2, MULTIPLE-FAMILY RESIDENTIAL ZONE, subject to the following conditions: 1. That a final tract map of subject property shall be submitted to and approved by the City Council and then be recorded in the Office of the Orange County Recorder. 2. That the owners of subject property shall pay to the City of Anaheim the appropriate park and recreation in-lieu fees as determined to be appropriate by the City Council, said fees to be paid at the time the building permit is issued. 3. That trash storage areas shall be provided in accordance with approved plans on file with the Office of the Director of Public Works; that trash areas along the north and east peripheral drive be relocated to the west and south sides of said drive as stipulated to by the Applicant. 4. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. 5. That all air conditioning facilities shall be properly shielded from view. ""............ 6. That a six-foot masonry wall shall be constructed along the north and east property lines. 7. Prior to the introduction of an ordinance rezoning subject property, Condition No. I, above mentioned, shall be coapleted. The provisions or rights granted by this resolution shall become null and void by action of the City Council, unless said conditions are complied with within one year from the date hereof, or such further time as the City Council may grant. 8.
