RESOLT'TION ORDERING ` "uORK. RESOLVED BY THE BOARD OF TRUSTEES OF 7F CITY OF ANAHEIM: SECTION 1. That the public interest and convenience require and the Board of Trustees of the City of Anaheim, pursuant to Resolution of Intention No. 173 of the Board_ of Trustees of the City of Anaheill, ,nlhiclh -Uid csoliitlo' -n of Intention 'No. -1 7' 1 1. � - ,o &s duly passed and adopted by said Board of Trustees on the 15th day of April, 1923, hereby order,-, the following; described street work to be done in sndd city, to-wit: That the roadway of South West Street from the southerly property line of West Center Street produced wester ly across the roadway of said Souiir West Street to the northerly property line of West Broadway Street produced westerly across the roadway of saN South Nest Street (excepting therefrom that portion of the roadway of South i W(i st Street lying between the north- j eily property line of West Chestnut Street produced easterly to the center ine of the roadway of said South West Street and the southerly property line 1 , of West Chestnut Street produced east. -' erly to the center line of the roadway of said South West Street) and That the roadway of North Emily Street frcm the southerly property line of East Chartres Street produced easterly across the roadway of said North Emily Street to the northerly property line of East Center Street pro- duced easterly aerose the roadway of said North Emily Street; be graded to 1 the official grade and paved with hy- draulic concrete base and with as- phaltic concrete wearing surface. Said work shall be done in accord - ance wish the plans, profiles, and speci- fications'therefor, which said plans and profiles were adopted by the Board of I Trustees of the City of Anaheim, by resolution, or the 15th day of March, 1223, and are Numbered 22 and 23, re- i spectively and are marked and desig- n-ted "plan of proposed improvement of South West Street," and 'Plan of proposed improvement on North Emily I Street," respectively and are on file in the office- of the City Engineer of said city, and which said specifications were adopted by the Board of Trusteesi of the, City of Anaheim on the 8th day of March, lf and are marked and ! designated "Specifications No. 28, for the construction of street paving with hydraulic concrete base and asphaltic concrete wearing .surface." SECTION 2. It is further hereby determined and declared in pursuance of .aid Resol�:tion of Intention No. 173 that serial bonds shall be issued to rel"'e- sent assessments of $25.00 or over, for the cost and expenses of said work and improvement that said serial bonds shall extend over a period of nine years from the aaronl day of January, next,I snceeeding their date and an even an- nual proportion of the principal sum , thereof shall be payable, by coupon, on the 2nd day of January every year after their date, until the whole is Pala, and the interest shall be payable semi- annually, by n coupon, on the 2nd day of January and July respectively, of 1 -1- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 each year at the rate, of seven per cent 1 per annum on all sums unpaid until the I whole of said principal and interest are, paid. I Said bonds shall be issued under and I by virtue of the provisions of an Act of the Lc-gislawre of the State of Cali - b rnia cntitied, "An Act to provide for' work in and upon streets, avenues, h,nes, alleys, courts, places and side-' walks within mutkicipa!ties and upofl propetty and rights of way owned by municipalities and for establishing and changing the grades of any such streets, avenaes, lanes, alleys, courts, places and sidewalks, and providing for the issuance and payment of street im- provement bonds to represent certain assessments for the cost thereof, and providing a nietbod for the payment of such bonds," approved April 7, 1911, and all acts amendatory thereof. SECTION 3. All of the herein proposed work and itprove- ment and all proceedings taken in regard thereto shall be in pur- suance of and in accofdazce with an Act of the Legislature of the State of California, entitled, "An Act to provide for work in and upon streets, avenues, lanes, alleys, courts, places and sidewalks within municipalities and upon propertq and rights of way owned by municipalities and for establishing and changing the grades of any such streets, avenues, lanes, alleys, courts, places and sidewalks, and providing for the issuance and payment of street improveiment bonds to represent certain assessments for the cost thereof and providing a method for the payment of such bonds," approved April 7, 1911, and all acts amendatory thereof. SECTION 4, The City Clerk of the City of Anaheirr is hereby directed to post, conspicuously for five days, on or near the chamber door of the Board of Trustees of said City of Anaheim, a notice of said viork inviting sealed, proposal or bids and a copy of specifications No. 28, adolpted by the Board of Trustees of the said city of Anaheim on the 8th day of March, 1923; he is also directed to cause a copy of said notice to be published twice in the Orange County Plain Dealer, a daily newspaper of general circulation, printed, published and circulated in said city, Which said newspaper is hereby designated for that puppose. Said. notice shall invite sealed proposals or bids for -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 doing the work ordered and shall refer to the specifications post- ed and on file, which said notice shall require all proposals or bids offered to be accompanied by a check, payable to the City of Anaheiii,i, certified by a responsible band for an amount iT shall not be less than ten per cent of the aggregate of the proposals or by a bond for the said, amount,so payable, signed by the bidder and .two sureties who shall justify before any officer competent to administer an oath, in double the sa-id amount and over and above EL11 statutory exemptions. Thursday, the 10th day of May, 1923, is hereby designated and fixed. as the day on which, up to the hour of eight o'clock P. M., the said proposals or bids shall be received,and the said notices shall so specify. The foregoing resolution was signed., attested and approved by me, this /2 Itt- day of April, 1923.
