RESOLUTION DECLARING CONTRACTOR IN DEFAULT
1- 7HEREAS, Edv- B. Garretson, on the 29th day of ,jay
1923, entered into a written contract with 0. E. Steward, as
Superintendent of Streets of the Cit7.,, of for the -.av-
ing of certain alleys i, the City of Anaheim, as - Drovided for
in Resolution of Intention 171, ado by said Bo, of
Trustees on the 15th day of 1 1923, and.
!IMEREAS, the time for the completion of said irork by
said Edw. B. Garretson has expired and said work has not been
completed; and it further appearing that said. , -ork has been
abandoned by said contractor;
NOW THEREFORE, said Board of Trustees hereby declares
said Edw. B. Garretson in default in the - performance of said
contract.
Be it further resolved that the United States Fidelity
end Guaranty Company, surety on the bond. of said Edw. B. Garret-
son, which bond. ra,s given by h,i as security forthe faithful
performance of said contract, be and said surety hereby is .
allowed up to and. includinp the 22nd day of August, 1923, with-
in rj` to begin the rork of completing said contract, and that
the said United States Fidelity and Guaranty Company, in the
event it be'�1 said ii-ork as aforesaid, be granted fifty (50)
days from and after the date of its comfence - nient of said work
within which to colyl-)Iete said. contract.
Be it further resolved that if said surety does not
begin said r, on or before said 22nd day of Au.aust, 1925, the
City Attorney be end he is hereby instructed. to instit suit
to recover on said bond.
