that the following described sewer work be done in said city,
to- wit: ` That sanitary sewer sh all be laid and constructed under
and along those portions of blic streets and alleys in the
City of Anaheim desi -nated as follows, to -wit: TTorth Palm Street,
from a point 159 feet TTorth of the orth line of West Center
Street to 1 3est North Street; Viest East ?TTorth Street from TTort
Palm Street, to a point 165 feet East of the east line of TTorth
Philadelphia Street; the north and south alley between ?TTorth Lem-
on Street and Forth Zeyn Street, from "lest yorth Street to a point
43 feet South of the south line of La Palma Street; The TTorth and
South alley between TTorth Zeyn Street and TTorth Dos Angeles Street,

,SEC TIGIT, 2. Said work shall be done in accordance with the
plans, profiles, and specifications for said. work, which said
plans and profiles were adapted by the Board of Trustees of the
City of Anaheim, by resolution on the 12th day of January, 1922,
and are marked and designated "Sewer System, Anaheim, California,
Profiles Fo. 7" and are in three sheets designated respectively
as "Sheet 1 11 , " Sheet 2," and "Sheet 3 11 and are on file in the of-
fice of the City Engineer of said city, and which said specifica-
tions were adopted by the Board of Trustees of the City of Ana-
heim, by resolution on the 22nd day of July, 1911, and are marked

and designated "Specifications for the construction of pipe sew-

1 e rs in the City of Anaheim, California," and are on file in the
2 office of the City Clerk of the City of Anaheim.
3 SECTION 3. That the City Clerk of the City of Anaheim be,
4 and he is hereby authorized and directed to publish for at least
5 ten days in the Anaheim Gazette, a newspaper of general circula-
6 tion, printed, published, and circulated in said city, a notice
7 inviting sealed proposals or bids for the furnishing of all labor
8 and materials for the doing of said work in accordance with said
9 plans and specifications, which said proposals or bids shall be
10 received by the Board of Trustees o f the City of isnahe im, at the
11 office of the City Clerk of said city, up to eight o'clock P. IA.,

12 of Thursday, the a 1 day of 1922, and the . Bo and of Trus
13 tees of the City of Anaheim reserves the .right to reject any and
14 all bids.
15 SECTION 4. All proposals or bids must be accompanied by a
16 check payable to the City of Anaheim, certified by a responsible
17 bank, for an amount which shall not be less than ten per cent of
18 the aggregate amount of the proposal, or a bond for the said
19 amount so payable, signed by the bidder and two sureties, who
20 shall justify before any officer competent to administer an oath,
21 in double the said amount, over and above all statutory exemption
22 or by a corporate surety, as provided by law, said check or bond
23 to become forfeited to the City of Anaheim in the event that the
24 successful bidder shall fail to enter into a contract for the do-
25 ing of said work, and furnish the bonds required within ten days
26 after the contract is awarded to him.
27 SECTION 5. The successful bidder shall, within ten days aftej
28 the contract is awarded to him, file with the Board of Trustees
29 of the City of Anaheim, a bond for an amount which shall not be
30 less than fifty per cent of the aggregate amount of the contract
31 price, for the furnishing of said materials and the doing of said

work, payable to the City of Anaheim and signed by the bidder
and at least two Sureties who shall justify before any officer
c ompetent to administer an oath in double the amounts over and a-
bove all statutory exemptions, or by a corporate surety Provid-
ed by law, which said bond shall be subject to the approval of
the Board of Trustees of the City of Anaheim, and shall be con-
ditioned upon the faithful performance of said contract.
The successful bidder shall likewise, within ten days after
the contract is awarded to him, and before entering upon the per-
formance of said work file with the City Clerk of the City of
Anaheim a good and sufficient bond to be approved by the Board
of Trustees of the City of Anaheim, in a Sam of not less than
one-half of the total amount payable by the terms of said con-
tract which said bond shall be executed by the contractor and
either at le St two a

bond, and mast provide that if the contractor, person, company,
or corporation, or his or its subcontractor fails to pay for any
m at e rials, provisions, provender, or other supplies, or teams

kind that the surety or Sureties will pay the same in an amount
not exceeding the sum specified in the bond, and also in case
suit is brought upon such bond, a reasonable attorney's fee to
be fixed by the court,

mechanic employed upon any of the work herein described, shall be
limited and restricted to eight hours during any one calendar day,
and the contractor shall forfeit as a penalty to the City of Ana-
heim, ten dollars, for each laborer, Workman, or mechaaic employ-
ed by him in the execution of said contract, or for any subcon-
tractor under him, upon any of said work herein referred to or
described for each calendar day durin., which such laborer, work-
man or mechanic is required or permitted to labor more than eight
hours in violation of the provisions of Section 653 0 of the Pen-
al Code of the State of California.
SEC TION 8. The minimum compensation to be paid for labor up-
on all work per-formed under and pursuant to the terms of said
contract shall be the Sam of Two dollars per day.
SECTION 9. The contractor shall at all times during the pr o-
re ss of the work contracted for, and at his own cost and expense
carry sufficient insurance, evidenced by policies issued and exe-
cuted by some reliable corporation thereunto duly authorized by
the laws of the State of California, or by the State Compensation
Insurance Fund of the State of California~ to indemnify and hold
harmlessl himself and the City of Anaheim from and against all
claims for damages arising out of the death or injury sustained
in the course of his employment by any workman, laborer, or em-
ployee, employed upon the viork contracted to be done and shall
at all times progress during the of such work, keep on file with
