Anaheim's water utility be self--supporting from charges made by
the City for installation of water mains, for water furnished to
consmner and all services rendered in connection therewith, and
~'i'HEP.EAS, the costs of many individual items of labor,
materials and equipment used by the water utility has substan-
tially increased since the present charges were established; and
:'i'fIEREAS, the utili ties Director has reconunended
increasing certain fees to offset these increas'as in costs; and
NHEREAS, the Utilities Director has recommended changes
in certain rates, rules and regulations tha-t will more nearly
conform with the policy of the City Council; and
dHEP..EAS, Section 10.16.420 of the Anai1eim l1unicipal
Code provides that the City Council shall, by resolution, fix
inst.allation charges and est:a:iJlish rates to be charged by the
City of Anaheim for water installation and water furnished to
consumers and services rendered in connection tLlerewith.

the City of Anahell~ that tile following rules and regulations for
water installation heretofore or hereafter made, and rates for
such installations; and for water furnishec', and services rendered
in connection therewith, be, and the same are, hereby est.ablished

WATER UTILITY POLICY
Under the prOVISions of the California Constitution, the Charter of
the City of Anaheim and Title 10 of the Municipal Code for the City
of Anaheim, the City owns and operates both public utility services
for water and electrical services for the citizens of Anaheim.
The objectives of the Water Utility organization are to plan and
carry out the development of the water resources of the City for the
greatest benefit to the area and to the citizens of Anaheim. This
includes providing dependable service without discrimination for the
residents of the City of Anaheim to the fullest extent possible, con-
sistent with overall sound business principles in planning, in financ-
ing, in construction of developments and in the operation and main-
tenance of the City's utility facilities. The accomplishment of these
objectives will make the maximum benefits to the public realized.
It is recognized that the City Council is the governing body of the
City and that they provide the utility services to the citizens of
Anaheim. Through the City Council's direction and guidance, the
City's management and supervisory personnel are continually antici-
pating the water service and related needs of all the customers in
the community and expect to be responsive to their needs and require-
ments. The Counci 1 strives to maintain the highest level possible
of capability of the personnel within the City organizations to
accomplish this service to the citizens of Anaheim.

COMMODITY ADJUSTMENT CLAUSE
APPLI CAB ILITY
Applicable to all areas served by the Utility and to all rate schedule
commodity charges.
PURPOSE
To provide for the automatic adjustment of the Utility's water rate schedule
commodity charges per 100 cubic feet whenever the cost per acre foot (A.F.)
of water is increased with respect to the base year of 1971-72 due to changes
in the Orange County Water District (OCWD) pump tax and/or the Metropolitan
Water District of Southern California (MWD) and The Municipal Water District
of Orange County (MWDOC) acre foot charge for filtered water. All water
purchased from MWD and MWDOC shall be deemed to be filtered water for the
purpose of computing the commodity adjustment.
Also, to establish the method for determining the cost of water per acre
foot and any resulting change (to the nearest mill) to the rate schedule
commodity charges per 100 cubic feet.
COST OF WATER
The cost of water shall be the sum of the percent water pumped times the
pump tax plus the percent of water purchased times the acre foot price.
For the base year 1971-72, 70 percent of the water was pumped and 30 percent
was purchased. Based on the pump tax and acre foot charges indicated below
for 1971-72, the cost of water for the base year is $25.00 per A. F. for all
water except irrigation and $15.10 per A. F. for irrigation water.

Computation of the amount of commodity adjustment to be applied to the rate
schedule commodity charges is illustrated in the following example:
If, in the fiscal year starting July 1. 1973, 70% of the water
is to be pumped and 30% is to be purchased, and the tax and price
are as shown. 30% then

Then $26.20 - $25.00 = $1.20 increase per A. F. compared to
base year. And since one A. F. = 43.560 cubic feet = 435.6
hundreds of cubic feet, then the commodity adjustment = $1.20/435.6 =
$.003 per 100 cubic feet (adjusted to the nearest mill).
Adjustment for irrigation service would be computed in a similar manner
using the base year average cost per acre foot of $15.10.
APPLICATION OF COMMODITY ADJUSTMENT
The commodity charge for all rate schedules shall be adjusted by the
Utilities Director on July 1 of each fiscal year to reflect the estimated
cost of water for the fiscal year compared to the cost of water for the
base fiscal year 1971-72. The increased cost of water shall be rounded
to the nearest mill per 100 cubic feet and added to the commodity charge
for each rate block of each water schedule rate charge.

C. In territory capable of being annexed to the City of Anaheim where
proceedings have been commenced in good faith for the annexation of
said territory to the City and where a petition for annexation is
filed with the City Clerk, signed by a majority of the registered
voters registering and residing in said territory proposed to be
annexed to the City, and by the owners of more than 50% of the value
of the territory proposed to be annexed, as shown by the last equalized
assessment roll, and said proceedings are diligently advanced, then in
the event, the water rates in such territory outside the city limits
shall be the same as the rates within the city limits for a period of
not to exceed six months. If said proceedings are not diligently
prosecuted to completion within said period of time mentioned, or
such further time as the City Council may grant, the rates for the
sale and delivery of water outside the City shall be put into effect.

the City Clerk, signed by a majority of the registered voters regis-
tering and residing in said territory proposed to be annexed to the
City, and by the owners of more than 5~!o of the value of the territory
proposed to be annexed, as shown by the last equalized assessment roll,
and said proceedings are diligently advanced, then in the event, the
water rates in such territory outside the City limits shall be the
same as the rates within the city limits, for a period of not to
exceed six months. If said proceedings are not diligently prosecuted
to completion within said period of time mentioned, or such further
time as the City Council may grant, the rates for the sale and
delivery of water outside the City shall be put into effect.

B. Prorating annual customer charge:
1. No adjustment of customer charge billed to date of change.
2. New customers starting service after April 30 and before
October 31 will pay a pro rata charge of 1/6 of the annual
customer charge for each month left in the season. After
October 31, customer will pay no customer charge until the
new season starts.
3. Not less than one full year's customer charge will be billed
for any fraction of a year.
C. A customer shall not resell water to another person. Each meter
point will be considered as one customer. Water associations or
companies taking delivery of water hereunder must take delivery
at one point, and distribute and account for each of their members'
usage.
D. Effective July 1, 1971, the irrigation water service rate is closed
to new customers with parcels of land where less than one acre is

the service shall pay the following charge per monthly service: The

or W-GO, plus the minimum monthly charge for 6-inch, 8-inch, or 10-inch
meter as established by the General Water Service Schedules added together
to create the total charge for the connection service for the interim
period between the time that the service is connected and a 6-inch, 8-
inch, or IO-inch meter is delivered and installed.
SPECIAL CONDITION
If the Utility determines that very large quantities of water will be
used so that the minimum charge established above would be detrimental
to the best interests of the Utility, the Utility may bill the customer

DEFINITIONS
Applicant: The person, association, corporation or governmental agency
applying for water service.
Application: A written request to the Utility for service as distinguished
from an inquiry as to the availability of, or charges for such
service.
Billing Period: The time interval between two consecutive meter readings
that are taken for billing purposes.
City: The City of Anaheim, California, a municipal corporation.
City Clerk: The City Clerk of the City of Anaheim, California.
City Council: The City Council of the City of Anaheim, California.
Class of Water Service: The categories of water service established by
the various Rate Schedules. The classes of service are Residential
Service, General Water Service, Irrigation Water Service, Private
Fire Line Service, Temporary Service and Municipal Water Service.
Customer: The person in whose name service is rendered as evidenced by
the signature on the application, contract, or agreement for
that service, or, in the absence of a signed instrument, by
the receipt and payment of bills regularly issued in his name
regardless of the identity of the actual user of the service.
Customer's Mailing Address: The address specified in a customer's
application or contract, or any other address subsequently
given to the Utility by the Customer, to which any notice
or other cOlMlunication is to be mailed.
Date of Presentation: The date upon which a bill or notice is mailed
or delivered by the Utility to the customer.
Development Services Department: The Development Services Department
of the City of Anaheim, California.
Distribution Mains: Pipelines located in streets, highways, public
ways or private right-of-way, exclusive of service connections,
which are used to serve the general public with water.

General Water Service: The class of water service to commercial and
industrial consumers, and all other consumers not covered under
the other classes of service.
Gross Area of Applicants Property: The contiguous land area owned or
controlled by an applicant, including streets, but excluding
open areas for which water service will not be required within
a Special Facilities District, plus one-half the land area of
the abutting streets to which legal, recorded access exists at
the time of application for water service.
High Elevation System: The portion of the Utility's service area which
cannot be served by gravity from the August F. Lenain Filtration
PI ant.
Intennittent Service: Service which, in the opinion of the Utility, is
subject to discontinuance for a time or at intervals.
Low Elevation System:

requirements for a single-family accommodation. Hotels,
guest or resort ranches, tourist camps, motels, auto courts
and trailer courts, consisting primarily of guest rooms and/or
transient accommodations, are not classed as multifamily
accommodations.

Permanent Service: Service which, in the opinion of the Utility, is of
a permanent and established character. This service may be con-
tinuous, intermittent, or seasonal in nature.
Person: Any individual, group, or organization operating as a single
entity.
Point of Delivery: The point where the piping of the Utility is con-
nected to the piping of the customer, regardless of the location
of the Utility's meter.
Primary Distribution Mains: The system of distribution mains which forms
a grid to supply water to all portions of the Water System. These
mains generally are located within secondary and higher classi-
fication streets, but may be in other rights-of-way.
Rate Charges: Charges in the rate schedules may include the following:
Commodity Charge: That portion of the charge for service
which varies with the quantity of water consumed in accordance
with the rate schedule.
Customer Charge: That portion of the charge for service which
is a fixed amount without regard to water consumption in accord-
ance with the rate schedule.
Minimum Charge: The least amount for which service will be
rendered in accordance with the rate schedule.
Residential Service: The class of water service supplying water to
single and multifamily accommodations for household purposes,
including water used on the premises for sprinkling lawns,
gardens and shrubbery; washing vehicles, and other similar
and customary purposes pertaining to single or multifamily
accommodations.
Rules:
Tariff pages which set forth the application. of all rates,
charges and service when such applicability is not set forth
in and as a part of the rate schedules.

Secondary Distribution System: All water distribution facilities which
supply water from the primary distribution system or primary
distribution mains to the service connection. These facilities
are generally located within collector and local streets, but
may be in other rights-of-way. The secondary distribution
system includes, but is not limited to: Mains, pressure
regulators and fire hydrant installations.

This rate is computed by dividing the gross area of the Special
Facilities District into the cost of Special Facilities required
to supply the District.
Special Facilities District: An area within the High Elevation System
where a Special Facilities Charge is calculated by the Utility
to pay for the Special Facilities within that area.
Tariff Page: An individual page of the tar.ff schedules.
Tariff Schedules: The entire body of effective rates, rentals, charges,
and rules collectively of the Utility, as set forth herein, and

Temporary Service: Service for enterprises or activities which are
temporary in character, or where it is known in advance that
service will be of limited duration. Service, which in the
opinion of the Utility, is for operations of a speculative
character or the permanency of which has not been established,
also is considered temporary service.
Tract or Subdivision: An area which may be identified by filed sub-
division plans or as an area in which a group of dwellings
may be constructed about the same time, either by a large
scale builder or by several builders working on a coordinated
basis.
Utilities Director: Utilities Director, City of Anaheim, Utilities De-
partment.
Utility: The City of Anaheim - Utilities Department.
Utility's Operating Convenience: The term refers to the utilization,
under certain circumstances, of facilities or practices not
ordinarily employed which contribute to the over-all efficiency
of the Utility's operations; it does not refer to customer
convenience nor to the use of facilities or adoption of practices
required to comply with applicable laws, ordinances, rules or
regulations, or similar requirements of public authorities.

DESCRIPTION OF SERVICE
A. QUANT IT! ES
The Utility will endeavor to supply water dependably and safely
in adequate quantities to meet the reasonable needs and require-
ments of customers.

B. PRESSURES
1. The Utility will generally maintain minimum operating pressures
at the service connection of not less than twenty-five pounds
per square inch (25 psi). Pressures may be lower at times of
maximum demands, or because of unusual topography or other
special conditions.
2. The Utility will generally maintain maximum operating pressures
at the service connection of not more than one hundred seventy-
five pounds per square inch (175 psi). Pressures may be higher
at times of minimum demands, or because of unusual topography
or other special conditions.
3. It shall be the responsibility of the customer to install and
maintain any booster pumps, pressure regulators, relief valves,
etc., as required by the Development Services Department to
meet the operating pressures and in order to accommodate to the
Utility's Water System.
C. QUALITY
Whenever furnished for human consumption or for domestic uses, the
Utility will endeavor to provide water that is wholesome, potable,
in no way harmful or dangerous to health and, in so far as practicable,
free from objectionable odors, taste, color and turbidity.

APPLICATION FOR SERVICE
A. APPLICATION FOR SERVICE
Each applicant for utility service may be required to sign an ap-
plication on a form provided by the Utility and, upon request, will
be required to furnish the following information: .
1. Name of appl icant.
2. Date and place of application.
3. Location of premises to be served.
4. Date applicant will be ready for service.
5. Whether the premises have been heretofore supplied.
6. Purpose for which service is to be used.
7. Customer's mailing address.
8. Whether applicant is owner or tenant of, or agent for,
the premises.
9. Rate schedule desired if optional rate is available.
10. Information to establish credit of applicant.
11. Such other information as the Utility may reasonably require.
The above information may be supplied by the applicant either in
writing or by telephone if the applicant's signature is not required.
The application is a request for service and does not in itself bind
the Utility to serve except under its filed tariff schedules, nor
does it bind the customer to take service for a longer period than
the minimum requirements of the rate schedule.
B. INDIVIDUAL LIABILITY FOR JOINT SERVICE
Two or more persons who join in one application or contract for
service shall be jointly and severally liable thereunder and
shall be billed by means of a single periodic bill mailed to the
person designated on the application to receive the bill.
C. CHANGE IN CUSTOMER'S EQUIPMENT OR OPERATIONS
Customers shall give the Utility written notice of the extent and
nature of any material change in the size or character of the
plumbing, equipment or operations for which the Utility is sup-
plying service before making any such change.

thereafter believe you have been billed incorrectly, the amount
of the bill should be deposited with the Utilities Director to
avoid discontinuance of service. Make remittance payable to
the City of Anaheim and attach the bill and a statement supporting
your belief that the bill is not correct. The Utilities Director
will review the basis of the billed amount and authorize any
adjustment required in accordance with his findings. If the
matter is not satisfactorily resolved with the Utilities Director,
you may petition the City Council for final determination."

2. The applicant's credit becomes impaired by other means.

B. ESTABLISHMENT OF CREDIT - OTHER THAN RESIDENTIAL SERVICE
Each applicant for non-residential utility service will be required
to satisfactorily establish credit which will be deemed established
upon qualifying under anyone of the following:

1. An applicant who previously has been a customer of the Utility
and whose service has been discontinued by the Utility during
the past twelve months of that prior service because of non-
payment of bills, may be required to re-establish credit by
depositing the amounts prescribed in Rule No.7 for that
purpose, and by paying utility bills regularly due; except,
an applicant for residential service will not be denied
service for failure to pay such bills for other classes of
service.
2. A customer who fails to pay bills before they become past due
as prescribed in Rule No. ll-A, and who further fails to pay
such bills by the date indicated on a discontinuance of service
notice for nonpayment of bills, may be required to pay said
bills and re-establish his credit by depositing the amount
prescribed in Rule No.7. This rule will apply regardless of
whether or not service has been discontinued for such non-
payment.
3. A customer using other than residential service may be re-
quired to re-establish his credit in accordance with Rule
No. 6-B in case the conditions of service or basis on which
credit was originally established have, In the opinion of the
Utility, materially changed.

RULE NO. 1
DEPOSITS
A. GENERAL
Deposits will be required when the Utilities Director of the City
of Anaheim has determined it is in the best interests of the City
of Anaheim.
B. AMOUNT OF DEPOSIT
The amount of deposit required to establish or re-establish
credit for service is twice the estimated average bill; but in
no case shall the amount be less than Ten Dollars ($10.00) for
each service.
C. RETURN OF DEPOSIT
1. Upon discontinuance of service the Utility will refund the
customer1s deposit or the balance in excess of the unpaid
bills for service; except the City shall not be required to
refund any advanced deposit balance where the cost to the
City for processing such refund. which is herewith determined
to be .Fifty Cents ($.50) exceeds said advanced deposit balance.
2. After the customer has paid bills for service for twelve con-
secutive months without having had more than two past due bills,
as defined in Rule No. II-A. the Utility will refund the deposit.
If the customer has had more than two past due bills. the
Utility will thereafter review the account every twelve months
and will refund the deposit after the customer has not had
more than two past due bills during the twelve months prior to
any review.
3. The Utility may return the deposit at any time upon request.
provided the customer1s credit may otherwise be established in
accordance with Rule No.6.
D. I NTEREST ON DEPOS I TS
There shall be no interest paid on utility deposits held by the
City.
E. DEPOSITS FOR TEMPORARY SERVICE

RENDERING AND PAYMENT OF BILLS
A. RENDERING OF BILLS
I. Billing Period. Bills for water service will be rendered bi-
monthly, monthly, or as otherwise provided in the tariff
schedules. Bimonthly bills will be computed by doubling the
size of the monthly rate blocks and the monthly amount of the
customer, service or minimum charge.
2. Metered Service.
a. Bills for metered service will be based on meter registrations.
Meters will be read as required for the preparation of regular
bills, opening bills and closing bills.
b. If, because of unusual conditions or for reasons beyond its
control, the Utility is unable to read the customer's meter
on the scheduled reading date, the Utility may bill the
customer for estimated consumption during the billing period,
and make any necessary corrections when a reading is obtained.
Estimated consumption for this purpose will be calculated
considering the customer's prior usage, the Utility's
experience with other customers of the same class in that area,
and the general characteristics of the customer's operations.
Adjustments for any under estimate or over estimate of a
customer's consumption will be reflected on the first regularly
scheduled bill rendered and based on an actual reading follow-
ing the period of inaccessibility. Access to the meter,
sufficient to permit its being read, shall be provided by the
customer as a pre-requisite to the Utility making any adjust-
ment of water consumption billed on an estimated basis.
3. Pro rata computation.
a. All bills for water service rendered for periods of less
than 50 days or more than 80 dQys on a bimonthly billing
period, or for periods of less than 24 days or more than
36 days on a monthly billing period will be computed in
accordance with the applicable schedule, but the size of
the commodity blocks, and the amount of the customer,
service, minimum or flat rate charges, specified therein,
will be prorated on the basis of the ratio of the number
of days in the period to the number of days in an average
bimonthly or monthly period, which for this purpose shall
be taken as 60 days and 30 days, or as otherwise provided
in tariff schedules.

DISPUTED BILLS

A. When a customer and the Utility fail to agree on a bill for utiHty
service:
The customer may, in lieu of paying the disputed bill, deposit with
the Utilities Director of the City of Anaheim the amount claimed by
the Utility to be due.
Upon receipt of the deposit, the Utilities Director will review the
basis of the billed amount, communicate the results of his review
to the customer and make disbursement of the deposit.
B. Service will not be discontinued for nonpayment of the disputed
bill when deposit has been made with the Utilities Director pend-
ing the outcome of the review.
C. Failure of the customer to make such deposit within fifteen days
after receipt of the bill will constitute acceptance by the customer
of the bill as rendered, and warrant discontinuance of his service
in accordance with Rule No. 11.
D. If before completion of the Utilities Director's review, additional
bills become due which the customer wishes to dispute, he shall also
deposit with the Utilities Director the additional amounts claimed
by the Utility to be due for such additional bills before they become
past due and that failure to do so will warrant discontinuance of his
service in accordance with Rule No. 11.
E. If the bill is not satisfactorily resolved with the Utilities Director,
the customer may petition the City Council for final determination.
Failure of the customer to petition the City Council for final de-
termination within fifteen days after receipt of the Utilities
Director's findings, will constitute acceptance by the customer of the
findings.

DISCONTINUANCE AND RESTORATION OF SERVICE
A. PAST DUE BILLS
Bills rendered will be considered past due if not paid within
fifteen (15) days after date of presentation.
B. NONPAYMENT OF BILLS
I. When a bill for utility service has become past due and a dis-
continuance of service notice for nonpayment has been issued,
service may be discontinued if bill is not paid within the time
required by such notice.
2. A customer's service may be discontinued for nonpayment of a
bill for service previously rendered him at any location served
by the Utility provided such bill is not paid within five days
after presentation of a notice that present service will be
discontinued for nonpayment of such bill for prior service.
However, residential service will not be discontinued because of
nonpayment of bills for other classes of service.
3. If a customer is receiving more than one service, any or all
services may be discontinued when any service, regardless of
location, is discontinued for nonpayment. However, residential
service will not be discontinued because of nonpayment of bills
for other classes of service.
4. Under no circumstances may service be discontinued for non-
payment of a bill to correct previously billed incorrect
charges for a period in excess of the preceding three months,
unless such incorrect charges have resulted from the customer
not abiding by the tariff schedules.
5. Bills collected on the premises by a field utility representative
shall include a $2.00 collection fee.
C. UNSAFE EQUIPMENT

The Utility may refuse or discontinue service to a customer if
any part of his plumbing or other equipment, or the use thereof,
shall be determined by the Utility to be unsafe or in violation
of applicable laws, ordinances, rules or regulations of public
authorities, or if any condition existing upon the customer's
premises shall be thus determined to endanger the Utility's
service facilities, until it shall have been put in a safe
condition or the violation remedied.

The Utility does not assume any responsibility of inspecting or
repairing the customer's plumbing or other equipment or any part
thereof and assumes no liability therefor.
D. SERVICE DETRIMENTAL TO OTHER CUSTOMERS
The Utility will not provide service to any equipment, the
operation of which will be detrimental to the service of the Utility
or its other customers, and will discontinue water service to any
customer who shall continue to operate such equipment after having
been given notice by the Utility to cease so doing.
E. FRAUD
The Utility may refuse or discontinue service if the acts of the
customer or the conditions upon his premises are such as to indicate
to it an intent to defraud the Utility.
F. FAILURE TO ESTABLISH OR RE-ESTABLISH CREDIT
If, for an applicant's convenience, the Utility should provide
service before credit is established or should continue service
to a customer when credit has not been re-established in accordance
with Rule No.6, and he fails to establish or re-establish his
credit, the Utility may discontinue service.
G. NONCOMPLIANCE
Except as otherwise specifically provided in this Rule No. 11, the
Utility may discontinue service to a customer for noncompliance
with tariff schedules if, after written notice of at least five (5)
days, he has not complied with the notice. The Utility may dispense
with the giving of such notice in the event there exists in the
Utility's opinion a dangerous condition, thus rendering the Immediate
discontinuance of service to the premises imperative.
H. CUSTOMER'S REQUEST FOR SERVICE DISCONTINUANCE

When a customer desires to terminate his responsibility for service,
he shall give the Utility not less than two days' notice of his
intention and state the date on which he wishes the termination
to become effective. A customer may be held responsible for all

RULE NO. 11
TEMPORARY SERVICE
A. CONDITIONS OF SERVICE
The City shall, if no undue hardship to its existing customers will
result therefrom, furnish temporary service for construction work,
circuses, Christmas tree lots, bazaars, fairs, plumbing pressure
testing, or other similar uses, that because of their nature will
not be used steadily or permanently. All such services shall be
subject to the following conditions:
1. Application for temporary service with appropriate deposit shall
be made to the Utility. The deposits for temporary service shall
be refunded after charges for permits, water consumption, loss
or damage of meter and fittings, and installation and removal
charges have been deducted at the termination of service.
2. Temporary service connections may be terminated at any time,
and will be made at the discretion of the Utility.
3. Charges for loss or damage to meter and fittings will be based
upon current prices.
4. Temporary services shall generally be taken from existing
outlets on the water system or from fire hydrants designated
by the Utility. Any special outlets shall be installed at the
customer's expense.
5. Backflow prevention devices, and approved plumbing materials may
be required for certain types of uses, and shall be installed
at the customer's expense.
6. An Eddy Valve will be required on all fire hydrant connections.
B. METERED SERVICES
Generally all temporary services will b~ metered, and will be subject

If in the opinion of the Utility, the setting of a temporary meter
is impractical or uneconomical, a temporary unmetered service con-
nection can be made. Unmetered connections will be subject to the
following conditions.
1. Fees for unmetered services, other than spacers, shall be as

a. Deposit $100 per connection
b. Permit Charge - $3.00
c. Late Charge - $1.00 per day after expiration of permit.
2. For subdivisions requiring two inch or smaller meters, spacer
connections may be provided for the purpose of pressure testing
and for eliminating damage to permanent meters during the grading
of parkways. A maximum period of use is ninety (90) days, sub-
ject to extension by the Utility. After the expiration of the
permit, the Utility may remove the spacers and install the meters.

dwelling is occupied. There will not be any permit fees for
spacer connections.

CONTINUITY OF SERVICE
A. SHORTAGE AND INTERRUPTION
1. The Utility will exercise reasonable diligence to furnish a
continuous and sufficient supply of water to its customers
and to avoid any shortage or interruption of delivery thereof.
It cannot, however, guarantee a continuous or sufficient
supply or freedom from interruption.
2. The Utility will not be liable for interruption or shortage
of supply, nor for any loss or damage occasioned thereby.
3. Whenever, in the operation of the Utility's water system,
interruption in the delivery of water to customers results
from or is occasioned by causes other than the exercise by
the Utility of its right to suspend temporarily the delivery
of water for the purpose of making repairs or improvements
to its system, notice of any such interruption will not be
given to the customers of the Utility, but the Utility shall
exercise reasonable diligence to reinstitute delivery of
water.
B. TEMPORARY SUSPENSION FOR REPAIRS
The Utility, whenever it shall find it necessary for the purpose
of making repairs or improvements to its system will have the
right to suspend temporarily the delivery of water. In all such
cases, as reasonable notice thereof as circumstances will permit
will be given to the customer, and the making of such repairs
or improvements will be completed as rapidly as may be practicable
and, if practicable, at such times as will cause the least incon-
venience to its customers.
C. APPORTIONMENT OF SUPPLY DURING TIME OF SHORTAGE
Should a shortage of supply ever occur, the Utility will appor-
tion its available supply of water among its customers as auth-
orized or directed by the Utilities Director in the manner
that appears to him most equitable under conditions then prevail-
ing.

MAIN EXTENSIONS
A. DISTRIBUTION SYSTEM
The cost of all water distribution mains installed or extended
in the water system shall be paid for by the owner or developer
of the properties served by these mains according to the following
po 1 i ci es :
1. Water mains installed or extended on dedicated streets and
serving property within the City limits as they existed on
May 20, 1924, at the time of election on waterworks bond
issue, shall be laid at the expense of the Utility.
2. The total cost of water mains installed or extended in the
Helen and Lynch Industrial Tract and Commercial Street
Annexations shall be borne by the owners of property abutting
such mains since said annexations did not participate in the
waterworks bond payments.
3. Cost of installing or extending water mains on dedicated
streets and serving property within the following annexations
shall be borne as shown below, based on the degree of partici-
pation in the waterworks bond payments.

4. Primary Distribution Mains
a. Primary Distribution mains which supply water to all areas of
the system shall be paid for by acreage fees assessed on all
properties in the system except those properties excluded in
(1) above. The fees will be based upon gross acreage served
by domestic water service and/or fire protection, and will be
due at the time application for water service is made, or the
property is developed. This does not apply to application for
temporary or irrigation service. The water main extension fees
shall be as follows:
Single Family Residential Development
Multi-Family Residential and Commercial
Development
Industrial Development
$275 per acre
$330 per acre
$375 per acre
The above fees will be calculated to the nearest one hundredth
(.01) acre. Condominiums, Townshouse, Planned Unit Developments,
etc., will be considered Multi-Family Development for the purpose
of determining acreage fees. Developments not covered under any
of the above classifications shall be subject to the same fees
as Multi-Family Residential and Commercial Developments.
b. When a Primary Distribution main must be extended to a new sub-
division or development, the Utility will extend the main up to
five hundred (500) feet. If an extension greater than 500 feet
is required, the developer and the Utility will both participate
in the cost of the extension; the Utility paying for the first
500 feet, and the developer paying for the balance in addition
to the normal water main extension fees. If the Utility re-
quires a main larger than that required to serve a new develop~
ment, the developer will only pay the cost of the size required
to serve his property (minimum of 8" for residential, 10" for
commercial, and 12" for industrial). The developer's portion
of the cost shall be reimbursed to him without interest as
acreage fees are collected from others connecting to the
extended main within a refund area designated by the Utility
at the time the advance is made. The reimbursement agreement
shall be in effect for a period of ten (10) years. In no case
shall the reimbursements exceed the developers cost of the
extension.

5. The Secondary Distribution System will be paid for and installed
by the owners or developers of "the property that the system
serves. The Secondary Distribution System shall be designed
by the Utility, built in accordance with its specifications,
and shall be subject to its inspection. After completion of
the system, the owner shall dedicate it to the Utility, free
of all liens, together with all necessary rights-of-way for
future maintenance and upkeep.
a. Where a secondary distribution main must be extended to a
new subdivision or development, the main shall be paid for
and installed by the developer of the property to which the
main is extended. If, under this rule, a developer is re-
quired to extend a main across undeveloped land, the Utility
shall collect and return to the developer the proportionate
cost of the main crossing the undeveloped land if and when
such land is developed.
b. The Utility may extend portions of the Secondary Distribution
System prior to development at its cost provided these exten-
sions are considered to be in the best interests of the
Utility. The costs for any such extensions shall be reimbursed
to the Utility by the owners or developers of the property
served by these extensions when these properties are developed,
or application for water service is made.
c. Where half streets are developed, the developer of the half
street shall be required to pay for and install any portion
of the Secondary Distribution.System that is required by
the Utility. The proportionate share of the main's cost
shall be collected by the Utility from the owner or developer
of the remaining side of the half street when it is developed.
This fee shall be reimbursed to the original developer.
6.
Main Enlargements - When the Utility's present distribution system
will not meet the water demands of a customer or developer, the
customer or developer may be required to pay the cost of any
necessary main replacement, less credit for the expired life of
the existing main.

B. SPECIAL FACILITIES
The cost of all Special Facilities installed in the High Elevation
System shall be paid for by the owner or developer of the properties
served by these facilities according to the following policies:
1. The High Elevation System shall be divided into districts called
Special Facilities Districts, and the Special Facilities within
these districts shall be paid for by a Special Facilities Charge.
a. The Special Facilities Charge shall include the entire cost
of the facilities other than distribution mains required
to serve a Special Facilities District. This cost includes,
but is not limited to:
Engineering costs, cost of land for reservoirs, booster pump-
ing plants, water mains and access roadways; cost of reservoirs,
booster pumping plants, water mains, grading, paving, retain-
ing walls, curbs and drainage facilities; and the cost of all
other improvements necessary to make these facilities a perma-
nent operating water installation integrated with the water
system of the Utility.
Location, size, capacity and other specifications for the
above water facilities shall be prescribed by the Utility.
b. The Special Facilities Charge Rate shall be derived by the
Utility by dividing the gross acreage of the Special Facilities
District into the total cost of the Special Facilities needed
to serve that District. All operating property under the
control of the Utility; areas of freeways, open flood control
channels; or any other areas which are planned as open areas
not subject to development, improvement or any use requiring
water service shall be excluded from the gross area of the
Special Facilities District.
c. The applicants Special Facilities Charge shall be determined
by multiplying the gross area of the applicant's property by
the Special Facilities Charge Rate.
d. Where the cost of Special Facilities,which are necessary to
serve an applicant's property, is greater than the appli-
cant's Special Facilities Charge, the applicant shall be
required to advance the difference.

These advance payments of Special Facilities Charges by an
applicant will be subject to refund without interest during
a period of twenty years. Such refunds shall be made from
Special Facilities Charges collected by the Utility within
a refund area designated by the Utility at the time the advance
Is made. If a refund area includes an area where further Special
Facilities are required, no refund shall be made until financing
of these Special Facilities in this area are completed. The
total amount of refunds to an applicant shall not exceed the amount
advanced by him.
e. In instances where it appears that ownership of contiguous real
property has been recently so divided as to exclude most of the
poor or unusable land from the water applicant's property owner-
ship which has the effect of avoiding the payment of Special
Facilities Charges on such poor or unusable land, the Utility
shall first compute a new Special Facilities Charge based on
the collection of charges only for a comparable portion of good
usable area within the Special Facilities District instead of
the gross area of the entire District. The total Special
Facilities Charge for this applicant's divided or smaller prop-
erty shall then be based on this new Special Facilities Charge.
f. The Special Facilities Charges for water service are due and
payable when application for water service is made or the
property is developed.
2. An applicant mayor may not be required to pay the Special Facilities
Charge for temporary service, depending on the circumstances involved.
Applicants for temporary service may claim special conditions exist
which will then be resolved as further provided herein.
C. SPECIAL CONDITIONS
1. Special Situations - Special conditions of service, facilities,
and related matters applicable to these Rules and Regulations not
expressly covered, shall be resolved by the Utilities Director.
2. Exceptional Cases - In unusual circumstances, when the application
of these rules appears impractical or unjust, the developer may
refer the matter to the Utilities Director for special ruling or
for the approval of special conditions, which are agreed upon,

SERVICE CONNECTIONS, METERS, AND CUSTOMER'S FACILITIES
A. GENERAL
I. For all services, other than those where the developer is Installing
the main, the Utility shall furnish and install the service connection,
meter and meter box after application is made and all
applicable fees are paid.
2. In new subdivisions, and in other cases where the developer Installs
the mains, the developer shall furnish and install the service
connection, and the Utility shall furnish and Install the meter
and lIleter box.
3. The service connection, meter, and meter box will generally
be installed at a convenient location between the curb or
edge of pavement and the property line. If it Is considered
impractical to install the facilities In this location, they
may be installed upon the customer's Premises In which case
an easement will be required.
4. The service connection will generally determine the point of
delivery of water service to the customer.
B. SERVICE CONNECTION AND WATER METER INSTALLATION CHARGES
I. For service connections and water meter installations under
(3) and (4) below, all materials shall be furnished and
Installed by the Water Division.
2. For service connections and water meter installations under
(5) and (6) below, the service connection shall be furnished
and installed by the developer in accordance with Water
Division specifications. The meter box and meter shall be
furnished and Installed by the Water Division. It Is in-
tended that (5) and (6) below apply to new subdivisions and
other developments where the developer is installing the
in-tract water distribution facilities.
3. Inside City Limits (Where Utility Installs Main):
1 Inch service with 5/8 x 3/4 inch meter $185.00
1 Inch service with I inch meter 235.00
2 inch service with I 1/2 inch meter 515.00

miscellaneous and incidental costs (excluding bores where
bores are required on only one side of a street).

subject to refund or charge if estimate is under or
over actual completed cost.
8. Connections requiring a cast iron meter box cover.
There will be a charge of $25.00 in addition to charges
under (1) and (2) above.
9. In the event a customer is required or requests a larger
service connection and/or meter for his property, the net
salvage value of the existing service connection and/or
meter will be subtracted from the price of the new one.
C. CUSTOMER'S RESPONSIBiliTY
The customer as a condition precedent to receiving service shall:
1. Furnish and lay the necessary piping to make the connection
to the place of consumption.
2. Provide a main valve on the piping between the service
connection and the point of customer use, as per
Development Services Department Standards.
3. Provide a bacteria clearance certificate for services 3 inch
and larger, except fire lines.
D. OWNERSHIP AND ABSENCE OF RENTAL OBLIGATION WHERE FACILITIES ARE
ON PREMISES OF CUSTOMER
1. The service pipe, curb stop, meter, and meter box located
wholly or partially upon a customer's premises are the
property of the Utility.
2. No rent or other charge will be paid by the Utility where
the Utility owned service facilities are located on a
customer's premises.
E. ACCESS TO PREMISES OF CUSTOMER
1.
The Utility shall at all reasonable hours have access to meters,
service connections and other property owned by it which may
be located on customer's premises for purposes of installation,

meter reading, maintenance, operation or removal of the property
at the time service is to be terminated. The customer's system
should be open for inspection at all reasonable times to autho-
rized representatives of the Utility.
2. Any inspection work or recommendations made by the Utility or
its agents in connection with plumbing or appliances or any
use of water on the customer's premises, either as a result
of a complaint or otherwise, will be made without charge.
F. CROSS CONNECTIONS
I. Protective Regulation
No physical connection between the potable water supply
system of the Utility and that of any other water supply
will be permitted except in compliance with the regulations
of the State Department of Public Health contained in Title 17
of the California Administrative Code under "Regulations
Relating to Cross-Connections."
2. Protective Devices Required
The Utility will require the installation of approved backflow
protection devices of required type under any of the following
condi tions:
a. Where a fresh water supply which has not been approved
by the State Department of Public Health is already
available from a well, spring, reservoir or other source.
(If the customer agrees to abandon this other supply and
agrees to remove all pumps and piping necessary for the
utilization of this supply, the installation of backflow
protective devices will not be required.)
b. Where salt water, or water otherwise polluted, is available
for industrial or fire protection purposes at the same
premises.

c. Where the premises are or may be engaged in industrial
processes using or producing process waters or liquid
industrial wastes, or where the premises are or may be
engaged in handling sewage or any other dangerous
substance.
d. Where the circumstances are such that there is special
danger of backflow of sewage or other contaminated liquids
through plumbing fixtures or water-using or treating
equipment, or storage tanks and reservoirs.
3. Type and Expense of Protective Devices
Any backflow protective device utilized Shall be of the type
and design specified and approved for the circumstances by
the Foundation for Cross Connection Control Research,
University of Southern California, and/or the Los Angeles
Plumbing Test Lab and such device shall be installed by and
at the expense of the customer, in a manner approved by the
Utility and the public health agency having jurisdiction when
so required, and in a location which is readily available for
periodic inspection.
4. Periodic Inspection of Protective Devices
Whenever backflow protective devices are installed, the
customer shall have competent inspections made thereof at
least once a year, or more often in those instances where
successive inspections indicate repeated failure thereof.
These devices shall be repaired, overhauled or replaced at
the expense of the customer whenever they are found to be
defective. Records of such tests, repairs and overhaul shall
be kept and made available to the Utility and the public health
agency having jurisdiction.
5. Refusal to Serve or Discontinuance of Service for Failure to
Install Protective Devices
The Utility may refuse or discontinue service until there has
been installed on the customer's piping approved devices of
the required type to protect against backflow of water from
the customer's premises into the Utility's system.

METER TESTS AND ADJUSTMENT OF BILLS FOR METER ERRORS
A. TESTS
1. On Customer Request. A customer may, on notice of not less
than one week, require the Utility to test the meter for his
service.
No charge will be made for such test, but, should a customer
demand a test within six months after installation or more
often than once in six months, he will be required to make a
deposit to pay, in part, the cost of the test. This deposit
will be returned if the meter is found to register more than
2% fast or 5% slow.
The amount of the deposit required is dependent on the size
of meter, and is listed below:
5/8" x 3/4" Meter $2.50
1" Meter 3.00
1/2" Meter 3.50
2" Meter 4.00
3" Meter 6.00
4" Meter 8.00
6" or larger meter 10.00
2. A customer shall have the right to require the Utility to
conduct the test in his presence or in the presence of an
expert or other representative appointed by him. The
results of the test will be furnished to the customer within
a reasonable time after completion of the test.
B. ADJUSTMENT OF BILLS FOR METER ERROR
I. Fast Meters. When, upon test, any meter is found to be
registering more than 2% fast, the Utility will refund to
the customer the amount of the overcharge based on corrected
meter readings for the preceding six months, subject to the
provisions of paragraph 4 hereof.
2. Slow Meters. When, upon test, any meter for domestic service
is found to be registering more than 25%slow, or any meter for
other class of service is found to be registering more than 5%
slow, the Utility may bill the customer for the amount of the
undercharge based on corrected meter readings for the preceding
three months, subject to the provisions of paragraph 4 hereof.

3. Nonregistering Meters. When, upon test, any meter is found
to be nonregistering, the Utility may bill the customer for
the estimate of water consumed but not registered for a period
of three months, subject to the provisions of paragraph 4
hereof.
Bills for this purpose will be estimated from the customer's
prior use, the customer's subsequent use correctly metered,
the Utility's experience with other customers of the same
class, and the general characteristics of the customer's
operation.
4. When it is found that the error in a meter is due to causes,
the date of which can be reliably established, the overcharge
or the undercharge will be computed back to but not beyond that
date, provided, however, that in no case will a bill for under-
charge on domestic service schedules be rendered for a period
exceeding three months.

AND RESALE OF WATER
A. NUMBER OF SERVICES TO SEPARATE PREMISES
Separate premises under single control or management will be
supplied through separate individual service pipes unless the
Utility elects otherwise.
B. SERVICE TO MULTIPLE UNITS ON SAME PREMISES
Separate houses, buildings, living or business quarters on the same
premises or on adjoining premises, under a single control or manage-
ment, may be served at the option of the applicant by either of the
following methods:
I. Through separate servi'ce connections to each or any uni t
provided that the piping system from each service is independent
of the others, and is not interconnected.
2. Through a single service connection to supply the entire
premises.
The responsibility for payment of charges for all service
furnished to combined units through a single service pipe, in
accordance with these rules, must be assumed by the applicant.
C. RESALE OF WATER
A customer shall not resell water to another person at any charge
higher than his pro rata share of the total charges as rendered
by the Utility. This paragraph shall not apply to a flat rate
charge as a portion of the rental of the premises or space
occup i ed.

A. METHOD OF MEASURING SERVICE
1. Metering
All water sold by the Utility will be upon the basis of metered
volume sales except that the Utility may at its option provide
flat rate or estimated service for the following:
a. Temporary service where the water use can be readily estimated.
b. Public fire protection service.
c. Municipal service as provided for in Rate Schedule W-MU.
2. Charges for Meter Installation
The charges for meter installation shall be as specified in
RULE NO. 16, "Service Connections, Meters, and Customer's
Facilities,"and RULE NO. 13, "Temporary Service."

RULE NO. 20
FIRE PROTECTION
A. PRIVATE FIRE PROTECTION
1. Private fire protection services will be provided under the
conditions specified in RULE NO. 16, "Service Connections,
Meters, and Customer's Facilities."
2. The rates for private fire protection services are specified
in RATE SCHEDULE W-PFL, "Private Fire line Service."
B. PUBLIC FIRE PROTECTION
I. The location of all public fire hydrants shall be determined by
the Utility and the City of Anaheim Fire Department.
2. Where public fire hydrants are installed on Primary Distribution
Mains, the cost for these hydrants shall be borne by the property
benefitting from these hydrants according to the following rules:
a. Where hydrants of standard spacing are installed on one
side of a right-of-way to serve both sides of a right-of-
way, there shall be a front footage of $1.00 per foot on
property which fronts this right-of-way. Street intersections
shall not be included in the calculation of the fees, however
corner lots will be required to pay the appropriate charges
on each side of a lot.
b. Where hydrants of standard spacing are installed on both
sides of a right-of-way, the front footage charge shall
be $2.00 per foot. Street intersection and corner lots
shall be treated as outlined in (a.) above.
c. Where hydrants of standard spacing are installed to serve only
one side of a right-of-way, the front footage charge shall be
$2.00 per foot.
d. The above fees are due at the time application for water
service, other than temporary, is made or the property is
developed.
3. If public fire hydrants in addition to those of a standard spac-
ing are requested by a customer or required by the City of Anaheim
Fire Department as a condition of development, the Utility may
install these hydrants at the customer's expense.

4. If a customer requests that a public fire hydrant be relocated,
the Utility shall relocate it at the customer's expense pro-
vided that the relocation is agreed upon by the Utility and
the City of Anaheim Fire Department.
5. Public fire hydrants installed as a part of a main extension
by a customer shall be paid for by that customer and be subject
to reimbursement as outl ined in RULE NO. 15, "Main Extensions."
