RESOLUTION NO. 72R- 581
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING THE TEmtS AND CONDITIONS
OF AN ENCROACHMENT PERMIT AND AUTHORIZ ING THE
/- MAYOR AND CITY CLERK TO EXECUTE SAID ENCROACH-
MENT PERMIT WITH TEXACO VENTURES, INC. AND
ANAHEIM HILLS, INC. (71-2E)
WHEREAS, Texaco Ventures, Inc., a Delaware Corporation,
and Anaheim Hills, Inc., a California Corporation, Licensees,
are the owners of property in the City of Anaheim over which
the City owns an easement for public utility purposes; and
WHEREAS, Licensees wish to use a portion of said
easement for the installation of private 6-inch irrigation
sleeves in Anaheim Hills Road and La Paz Way, south of Santa Ana
Canyon Road; and
WHEREAS, unless Licensees are allowed to encroach upon
the easement of the City, an extreme and undue hardship will be
caused to them; and
WHEREAS, the proposed encroachment for the installation
of private irrigation sleeves across a portion of the easement
of City will not interfere with the present use of the easement
of the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the terms and conditions of a license
agreement between the City of Anaheim and Texaco Ventures, Inc.,
a Delaware Corporation, and Anaheim Hills, Inc., a California
Corporation, Licensees, dated December 12, , 1972, be and
the same are hereby approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
are hereby authorized and directed to execute said license
agreement on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by me
this 12th day of December , 1972.
