~lliERSAS, after a request for variance by MR. AND MRS.
DOI:JALD L. r.I(CIN'I'OSE, owners, and BILL ASAVJA, A.S.A.1iJ.A. CORPORA-
TION, agent, was received, a public hearing before the Planning
Commission of the City of Ana~eim was held upon due and proper
notice as a result of which Variance No. 2406 was denied cover-
ing the following described property:
Lot 2 of ~ract 1940 as per map recorded in Book 82,
pages 8, 9 and 10 of Miscellaneous Maps in the office
of the Recorder of said County.
WFLEREAS 1 thereafter, wi thin the time prescribed by laY?
an interested party or the Citv Council on its own motion caused
the review of said-planning Commission action at a public hearing
noticed and held on September 12, 1972, and sQ~sequently granted
a public rehearing noticed and held as prescribed by la,., on
November 28, 1972, and continued to December 5, 1972, and as a
result thereof tn8 City Council does hereby make the follmvinG
findings:
1. That there is no substantial property right possessed
by other property in the same vicinity and zone and
denied the subject property.
2. It appears that the subject property can.be adequately
developed and used under the present zone.
NOH, ThEREFORE f BE rr RESOLVED by the City Council of
the City of Anaheim that said Variance be, and the same is,
hereby denied.
