RESOLUTION NO. 72R-564
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHED1 DETERMINING THE NECESSITY FOR AND
DIRECTING THE ACQUISITION BY EMINENT DOMAIN
OF REAL PROPERTY FOR STREET AND PUBLIC UTIL-
ITY PURPOSES (Magnolia and Crescent Avenues).
WHEREAS, public convenience and necessity require the
acquisition of certain real property within the City of Anaheim
for the following purposes, to wit: highway easement and public
utility purposes; and
WHEREAS, the City Council does find and determine that
public interest and necessity require the acquisition of all
that real property herein described, by the City of Anaheim for
highway easement and public utility purposes.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that public interest and necessity require
the acquisition of the following described real property, to
wit:
An easement for road and public utility purposes over,
under and across the following described parcels of land
being a portion of the Southeast quarter of Section 12,
Township 4 South, Range 11 West, in the Rancho Los
Coyotes, as per map recorded in Book 51, page 11, Mis-
cellaneous Maps, records of Orange County, California.
PARCEL ONE:
Beginning at the northeast corner of the Southeast quarter
of said Section 12, said northeast corner being the intersec-
tion of the centerline of Crescent and Magnolia Avenue;
thence S 00 13' 47" E along the centerline of Magnolia
Avenue, 221.00 feet; thence S 890 39' 14" W, 40.00 feet;
thence N 000 13' 47" W, 115.76 feet; thence N 50 28' 51"
W, 50.25 feet; thence S 890 46' 13" W, 8.00 feet to a
point in a curve concave southwesterly having a radius
of 25.00 feet; a radial line passing through said point
bearing N 890 46' 13" E; thence northerly and westerly
along said curve through a central angle of 900 06' 59"
an arc distance of 39.32 feet; thence N 780 33' 37" W,
73.44 feet; thence N 000 20' 46" W, 15.00 feet to the
intersection with the centerline of Crescent Avenue;
thence N 890 39' 14" E along said centerline 150.00 feet
to the point of beginning.
Excepting therefrom the northerly 15.00 feet and the
easterly 30.00 feet lying within the existing right of
way of Crescent and Magnolia Avenue.
PARCEL TWO:

Beginning at the northeast corner of the Southeast quarter
of said section 12, said northeast corner being the inter-
section of the centerline of Crescent and Magnolia Avenue;
thence S 00 13' 47" E along the centerline of Magnolia
Avenue, 221.00 feet to the true point of beginning; thence
continuing southerly along said centerline 125.00 feet;
thence S 890 39' 14" W, 40.00 feet; thence N 000 13' 47" W,
125.00 feet; thence S 890 39' 14" W, 40.00 feet to the
true point of beginning.

Excepting therefrom the easterly 30.00 feet lying within
the right of way of Magnolia Avenue.

BE IT FURTHER RESOLVED that the City Council find, and
it does hereby find and determine, that public interest and
necessity require the acquisition of said property by the City
of Anaheim for the aforesaid purposes, and that the taking of the
property hereinabove described is necessary therefor, and that
the uses to which it is to be put are uses authorized by law, and
the taking of said property is neces$ary to such uses.
AND BE IT FURTHER RESOLVED that the City Council does
hereby authorize the acquisition of said property by the City of
Anaheim, and the City Attorney of the City of Anaheim is hereby
directed to institute an action in eminent domain for the acquisi-
tion of the title to said property, and to perform and carry out
all of the necessary proceedings and steps incident to the acqui-
sition of the title to said property and obtaining immediate
possession thereof.
THE FOREGOING RESOLUTION is approved and signed by me
this 28th day of November, 1972.
