A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AUTHORIZING COMPROMISING OF CERTAIN
EMINENT DOMAIN LITIGATION (Montgomery Property,
Orange Avenue at Danbrook Street).
WEREAS, heretofore, on the 11th day of October, 1972,
the City filed its Superior Court Action No. 196,614 in Eminent
Domain against Paul H. Montgomery, et ux, et al., for the condem-
nation of a road and public utility easement; and
WEREAS, the City Council finds that the fair and
reasonable value of the property so taken amounts to $2257.20
and that it would be in the best interests of the City to settle
said litigation for this amount; and
WEREAS, Defendant Paul H. Montgomery has indicated
his willingness to accept said $2257.20 as full settlement of
said litigation and has offered to furnish to the City of Anaheim
his Easement Grant Deed covering the property involv~d.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that it compromise the hereinbefore described
eminent domain litigation for the sum of $2257.20.
BE IT FURTHER RESOLVED that the Finance Director of
the City of Anaheim be, and he is hereby authorized and directed
to draw a City Warrant in the amount of $2257.20 in favor of
Paul H. Montgomery and Eva B. Montgomery, husband and wife, and
that he be directed to forward the same to the Office of the City
Attorney for transmittal.
THE FOREGOING RESOLUTION is approved and signed by me
