RESOLUTION NO. 72R-537

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM GRANTING AN ENCROACHMENT PERMIT
TO GROSS AND COMPANY, INC., ALONG KAT ELLA
OVERPASS EMBANKMENT SLOPE FOR INSTALLATION
AND MAINTENANCE OF LANDSCAPING.
WHEREAS, Gross and Company, Inc., has requested an
encroachment permit to permit the installation and maintenance
of landscaping on the embankment slope of the Katella OVerpass of
the Santa Ana Freeway, north of Katella Way and West of Manchester
Avenue; and
WHEREAS, said encroachment permit covers the following
described property:
That portion of the Katella Avenue overpass slope area
located in the City of Anaheim, County of Orange, State
of California, to be encroached upon, being a portion of
the Southwest quarter of the Southwest quarter of Section
23, Township 4 South, Range 10 West, S.B.B. & M., described
as follows:
COmMencing at the easterly terminus of the northerly line
of that certain parcel of land bounded completely on all
sides by Parcel One of the State Highway Relinquishment No.
525, as shown on a map filed in Book 4, pages 3 and 4 of
Highway Maps, records of said Orange County, said northerly
line shown as having a bearing and distance of S 810 11'
3011 W, 358.12 feet; thence N 390 46' 46" W, 66.19 feet to
the true point of beginning, said point of beginning being
a point in a curve concave northwesterly and having a
radius of 41 feet, a radial line bearing N 840 20' 05" E
passes through the point of beginning; thence Southwest-
erly and Westerly along said curve through a central angle
of 870 381 15" an arc distance of 62.71 feet; thence S
8P 58' 20" W, 287.03 feet; thence N 460 11' 20" E, 1.76
feet to a point, said point being the beginning of a curve
concave southeasterly and having a radius of 290 feet, a
radial line bearing N 330 061 40" W passes through said
point; thence Northeasterly along said curve through a
central angle of 210 26' 25" an arc distance of 108.52
feet; thence N 780 19' 45" E, 222.70 feet; thence S 390
46' 46" E, 3.76 feet to the true point of beginning.
AND WHEREAS, the City Council finds that all City depart-
ments and affected outside agencies have reviewed and approved
such encroachment and that it is in the best interests of the
City to grant such encroachment.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that it grant and it does hereby grant an
encroachment permit to Gross and Company, Inc. covering the herein-
above described property to permit the installation and mainten-
ance of landscaping on the embankment slope of the Katella Over-
pass of the Santa Ana Freeway, north of Katella Way and West of
Manchester Avenue subject to the following conditions:
a. That Gross and Company, Inc. post a bond in the
amount and form satisfactory to the City of Anaheim
to guarantee the installation of said landscaping,
sprinkler system, retaining wall, if necessary,

drainage swale and any proposed addition to or re-
vision of existing drainage facilities.
b.
That Gross and Company, Inc. coordinate the plans
of proposed landscaping with the City of Anaheim
Superintendent of Parkway Maintenance, and submit
a copy of said plans to the State Division of High-
ways for review and approval.
