72R-530 ,~ RESOLUTION NO. 72R-S30 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NOo 1341 WHEREAS, the City Planning Commission of the City of Anaheim did initiate and propose the granting of a conditional use permit from VIOLET VAN DELDEN, Owner; ROBERT E. BURGLIN, Agent, to establish a carwash on the following described property, situated in the City of Anaheim, County of Orange, State of Cali- fornia, to wit: The West 243.00 feet of that portion of the South half of the Northwest Quarter of the Northwest Quarter of Section 12, Township 4 South, Range 10 West in the Rancho San Juan Cajon de Santa Ana, County of Orange, State of California, as per map recorded in Book 51, page 10 of Miscellaneous Maps, in the Office of the County Recorder of said County, described as follows: Beginning at a point South 528.98 feet from the North- west corner of said South half; thence East 579.71 feet at right angles to the West line of said South half; thence Northeasterly in a direct line to a point South 424.25 feet from the Northeast corner of said South half; thence North 88.00 feet; thence West 1320.00 feet to said West line; thence South 192.73 feet to the point of beginning. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said application on sept~er 18 , 19 72 , notices of which said public hearing were uly given as required by law and the provisions of Title 18, Chapter 18076 of the Anaheim Municipal Code; and WHEREAS. said Commission, after due inspection, inves- tigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution No. PC72-243 Series qrantinq Conditional Use Permit No. 1341. subject to "F!rt-.,;n "onClit-ion!': thprF!in Sf'>t forth _ and -- WHEREAS, thereafter, within twenty-two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning Commission in arantinq said conditional use permit and did thereupon fix the ~4th day of N~xemblf ' 1972 , as the time and the Council hamber in the ~ty all of the City of Anaheim as the place for a public hearing upon said condition- al use permit, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and -1- ~.- _.,.;~ WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful con- sideration of the recommendations of the City Planning Commis- sion and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a conditional use permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not impose an undue burden upon the streets and high- ways designed and improved to carry the traffic in the area. 5. The granting of the conditional use permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commis- sion in ~r€nting said conditional use permit be, and the same is he e y sustained ,and that Conditional Use Permit No. 1341 be, and the same is hereby, granted permitting the establishment of a carwash on the property hereinbefore described, with waivers of the following Anaheim Hunicipal Code provisions: Section 18.40.040 Outdoor uses. (Car pOlish- ing proposed; car polishing not permitted) Section 18.40.070(3-a) I'1aximUTIl building height adjacent to single-family residential. (18 feet and 14 feet proposed; 15 feet and 7.5 feet permitted) That said Conditional Use Permit be granted subject to the follow- ing conditions: 1. .J.'hac all engineering requirements of the City of Anaheim along State College Boulevard and the public alley to the south, including preparation of improvement plans and . installation of all inlprovements such as curbs and gutters, s~de- walks, street grading and paving, drainage facilities or other appurtenant work, snaIl be complied with as requi~ed by.t~e C~ty Engineer and in accoraance wi,th stancJ.ard plans and spec~f~cat~ons -2- ,-".-.. on file in the Office of the City Engineer; tJ:lat street lighting facilities along State College Boulevard shall be installed as required by the Director of Public Utilities and in accordance with standard plans and specifications on file in the Office of the Director of Public Utilities; and that a bond in an amount and for') satisfactory to the City of Anaheim shall be pos'teet with the City to guarantee the installation of the above mentioned requirements. 2 .Cllat trash storage areas shall be provided in accordance with approved plans on file with the Office of the Director of Public Vvorks. 3. That any parkinq area lisrhting proposed shall be down- lighting of a maximQm height of six feet, which lighting shall be directed away from the property lines to protect the residen- tial integrity of the area. 4. That subject property shall be served by underground utilities. 5. That drainage of subject property shall be disposed of in a manner that is satisfactory to the City Engineer. 6. That the final parkinq plan shall be approved by the Development Services Department and any landscaped areas in the parking area shall be protected with six"inch high concrete curbs and concrete wheel stops shall be provided for parking spaces as required by the Development Services Deparbnent. 7. That subject proJ:)erty shall be developed substantially in accordance with plans and specifications on file with the Ci ty of Anaheir;, marked Exhibits Nos. 1, 2, 3 and 4, provided, however, that the parking on the south side of the property shall be redesigned with 900 spaces. 8. That Condition No.1, above mentioned, shall be com- plied with prior to the commencement of the activity authorized under this resolution or prior to the time that the building permit is issued or within a period of one year from the date hereof, whichever occurs first or such further time as the Planning Commission may grant. 9. That Conditions Nos. 2, 3, 4, 5, 6 and 7, above men- tioned, shall be complied with prior to final building and zoning inspections. The City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owners, their heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and conditions herein.
