1973-113 .-~ RESOLUTION NO. 73R-113 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO.137? for. 15 years. WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a conditional use permit from HIROSHI FUJISHIGE, owner, to establish a travel trailer park on the following described property: Commencing at the centerline intersection of Katella Avenue and Harbor Boulevard, as shown on a map filed in book 43, page 33 of Record of Surveys in the office of the County Recorder of said Orange County; thence South 10 21' 00" East along the centerline of said Harbor Boule- vard a distance of 1232.61 feet; thence North 880 39' DO" East a distance of 60.00 feet to the true point of beginning. Thence 1'1 010 21' DO" W a distance of 450 feet to the SW corner of the Holiday Inn property; thence N 890 44' 26" E a distance of 600.13 feet to the SE corner of the Holiday Inn property; thence N 00 IS' 34" W a distance of 120.03 feet; thence N 890 44' 26" E a distance of 900 feet to a point on the centerline of Clementine Street; thence along the centerline of Clementine Street, being a 90 foot street, 45 feet each side of this. centerline S 150 17' 22" VI a distance of 246 feet; thence along a tangent curve beinci concaved Southeasterly \'li th a radius of: 1000 fee t, t:l1rougil a cen.tr2,1 angl,,; of 150 32' 56" an arc CistaIICS of 271.38 f2e~ to a PT; thence S 00 15' 3411 E a distance of 85.00 feet to the intersection of the centerline of Cle::nt::1Ytine S.tr2ct and COl1v2.ntion r'Jay; t~1ence alOI1;tln c:.;Dt:"J~lin,~ 0:': COllvention -"1ay, being a 12::) foot. stree:c., Ge foo'::, GaC~~l si(le of this centerline S 880 1141 2G:: tJ a distarJ.c2 of 70.00 fee'ci thence along a tangent curve beiwJ concavcd Southeasterly and having a radius of 1200 feet, tliroug:, a central angle of 130 14' 33" an arc distance of 277.35 feet to a PRC; thence along a curve being concaved ,';orthwesterly and having a radius of 1200 feet, through a central angle of 130 14' 33" an arc distance of 277.35 feet to a PT; thence S 890 44' 26" W a distance of 765.00 feet; thence N 00 IS' 34" W a distance of 60.00 ft; thence along a tangent curve being concaved Northeasterly and having a radius of 25 feet through a central angle of 880 54' 34" an arc distance of 38.79 feet to a PT to the true point of beginning. - AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City o~ Anaheim upon said application on Februar* 21 ,1973 ,notices of which said public hearing were uly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, in- vestigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution No.PC73-40 Series , denyinq Conditiofial Use Permit No. 1377 and -1- '_L WHEREAS, thereafter within twenty-two (22) days from the date of the adoption of said resolution, a written appeal was filed with the City Council protesting the action of the City Planning Commission in denying said conditional use permit and said appeal was set for public hearing on March 27 , 1973 , at the City Hall, in the City of Anaheim, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful con- sideration of the recommendations of the City Planning Commis- sion and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a conditional use permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not impose an undue burden upon the streets and high- ways designed and improved to carry the traffic in the area. 5. The granting of the conditional use permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commis- sion in denvinq said conditional use permit be, and the same is hereby reversed , and that Conditional Use Permit No. 1377 be, and the same is hereby, granted permitting the establishment of a travel trailer park for a period of fifteen (15) years subject to the following condit~ons: 1. That the owner shall reimburse the City of Anaheim for his proportionate share of street improvement and utility installation costs as detailed in an agreement between Hiroshi Fujishige, et al, and the City of Anaheim and dated June 6: 1972. 2. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. 5. That a 6-foot masonry wall shall be constructed along the north property line and to the rear of the required setback along the east, south, and west portions of the property. 6. That subject property shall be served by under- ground utilities. 7. That the proposed development shall be in accordance with the requirements of the State Trailer Act, and that plumbing shall be provided in order that the mobilehome park will accommodate all trailers and not be restricted to "California approved trailers" only. 8. That this conditional use permit is granted subject to the completion of Reclassification No. 66-67-61, now pending. 9. That appropriate water assessment fees as deter- mined by the Director of Public utilities shall be paid to the City of Anaheim prior to the issuance of a building permit. 10. That subject property shall be developed substan- tially in accordance with plans and specifications on file with the City of Anaheim marked Exhibits Nos. 1, 2, 3, and 4, provided, however, that all landscaping shall be permanently maintained, including the replacement of trees or landscaping damaged or de- stroyed by vehicles entering or leaving the parking spaces, and further provided that a 20 foot wide landscaped setback shall be provided along Convention Way and Clementine Street, and the set- back along Harbor Boulevard shall comply with the required special setback standards as stipulated to by the petitioner. 11. That Condition No.2, above mentioned, shall be complied with prior to the commencement of the activity authorized under this resolution, or prior to the time that the building permit is issued, or within a period of one year from date hereof, whichever occurs first, or such further time as the City Council may grant. 12. That Conditions Nos. 3, 5, 6,7, and 10, above mentioned, shall be complied with prior to final building and zoning inspections. The City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owner, his heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions therein.
