A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF N~~{EIM APPROVING THE TE~~S i~~D CONDITIONS
AND AUTHORIZING THE EXECUTION OF N~ AGREEMENT
WITH THE ATCHISON, TOPEKA AND SN~TA FE RAILWAY
CONPN~Y PE}U1ITTING THE INSTALLATION OF A LOW
VOLTAGE CONTROL CABLE l'J'ID ATTACHMENTS TO COI1-
MUNICATION POLE LINE Ovn~ED BY SAID RAILWAY
COMPANY.
WHEREAS, the City of Anaheim requested permission to
attach a low voltage control cable to the communication pole
line owned by The Atchison, Topeka and Santa Fe Railway Company
near Atwood, California; and
~VHEP~AS, The Atchison, Topeka and Santa Fe Railway
Company, a Delaware corporation, has tendered to the City of
Anaheim a rental agreement dated June 25, 1973, permitting the
erection and/or maintenance, and operation by the City at its
own expense, upon terms and conditions therein set forth, and
on the poles owned by The Atchison, Topeka and Santa Fe Railway
Company; and
~~fEREAS, this rental agreement supersedes and cancels
rental agreement dated December 10, 1962, known in the files of
The Atchison, Topeka and Santa Fe Railway Company as Secretary's
Contract No. 67726; and
w~EREAS, the City Council does find and determine that
it would be for the benefit and best interest of the City of
Anaheim to enter into said rental agreement with said Railway
Company.
NOW, THEP~FORE, BE IT P~SOLVED by the City Council of
the City of Anaheim that the rental agreement, dated June 25,
1973, tendered to the City of Anaheim by The Atchison, Topeka
and Santa Fe Railway Company, a Delaware corporation, permitting
the City of Anaheim to erect and/or maintain and operate, at its
own expense, upon the terms and conditions therein set forth,
and on the poles owned by said Railway Company as follows:
Installation of a low voltage control cable across
the right of way of The Atchison, Topeka and Santa
Fe Railway Company and 30 attachments to communica-
tion pole line between Mile Pole 0 + 3122' and Mile
Pole 1 + 2617' on the Olive District near Atwood,
California. Total distance 4775 feet -- 30 attach-
ments @ 0.75 each per annum, the rental charge of
$22.50 to be paid annually, in advance,
be, and the same is hereby approved.
BE IT FURTHER RESOLVED that the Electrical Superinten-
dent be, and he is hereby, authorized to execute said agreement
for and on behalf of the City of Anaheim.

AND BE IT FURTHER RESOLVED that the Director of
Finance be, and he is hereby, authorized to pay to said
Atchison, Topeka and Santa Fe Railway Company annually, in
advance, the rental charge of $22.50, as set forth in said
agreement.
THE FOREGOING RESOLUTION is approved and signed by
me this 28th day of August , 1973.
