1973-348 RESOLUTION NO. 73R-348 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAIIEIH FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIH MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Pro- ceedings No. 73-74-6 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing, the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 21st day of Auqust , 19 73 , and continued to the day of , 19 , as the time, and the City Council Chambers in the City Harr-Qf the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incor- poration thereof in the zone or zones hereinafter set forth, and did give notice thereof in the manner and form provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and \iHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: 73-74-6 -1- -" That portion of the Southeast 1/4 of the Southwest 1/4 of Section 9, Township 4 South, Range 10 West, San Bernardino Base and Meridian, in the City of Anaheim, described as follows: Beginning at the Southwest corner of said Southeast 1/4; thence North along the West line of said South- east 1/4, a distance of 827.30 feet to the South line of the Anaheim Homestead Tract as per map re- corded in book 26, page 10, Miscellaneous Records, in the office of the County Recorder of Los Angeles County, California; thence Easterly along said south line of the Anaheim Homestead Tract, a distance of 606.95 feet; thence South 823.48 feet to the south line of said South- east 1/4; thence West along said last mentioned south line, 606.95 feet to the point of beginning. EXCEPT therefrom that portion lying Southerly of the Northerly line of the land described in the deed to the State of California, recorded May 26, 1954 in book 2734, page 592, Official Records of said Orange County. ALSO EXCEPT therefrom that portion lying southwesterly of the northeasterly line of the land described as Parcel 1 in the deed to the State of California, recorded January 13, 1956, in book 3352, page 437, Official Records of said Orange County. be excluded from R-A, AGRICULTURAL ZONE, and incorporated in C-l, GENERAL COMMERCIAL ZONE, subject to the following conditions: 1. That the sidewalks shall be installed along Wilshire Avenue as required by the City Engineer and in accor- dance with standard plans and specifications on file in the office of the City Engineer. 2. That the owner(s) of subject property shall pay to the City of Anaheim the sum of 60 cents per front foot along Wilshire Avenue for tree planting purposes. ...- 3. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. 4. That a six-foot masonry wall shall be constructed along the north property line. 5. That IS-gallon broad head trees be planted along the north property line 15 feet on center to provide an effec- tive screen five years after planting. 6. That all air conditioning facilities shall be properly shielded from view, and the sound buffered from adjacent properties. 7. That any parking area lighting proposed shall be down-lighting of a maximum height of six feet, which lighting shall be directed away from the property lines to protect the residential integrity of the area. -2- 8. That subject property shall be served by under- ground utilities. 9. That the final parking plan shall be approved by the Development Services Department, and any landscaped areas in the parking area shall be protected with six-inch high concrete curbs, and concrete wheel stops shall be provided for parking spaces. 10. That drainage of subject property shall be dis- posed of in a manner that is satisfactory to the City Engineer. 11. That appropriate water assessment fees as deter- mined by the Director of Public Utilities shall be paid to the City of Anaheim prior to the issuance of a building permit. 12. That subject property shall be developed sub- stantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibits Nos. 1 and 2. 13. Prior to the introduction of an ordinance rezoning subject property, Condition No.2, above mentioned, shall be com- pleted. The provisions or rights granted by this resolution shall become null and void by action of the City Council unless said conditions are complied with within one year frQm the date hereof or such further time as the City Council may grant. 14. That Conditions Nos. 1, 4, 5, 6, 7, 8, 9, 10 and 12, above mentioned, shall be complied with prior to final building and zoning inspections. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
