1973-242 ,~, RESOLUTION NO. 73R-242 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAIIEIH FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIH MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. mIEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Pro- ceedings No. 72-7~-44 to consider an amendment to Title 18 of the Anaheim Munic1pal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and mIEREAS, wi thin a period of forty days following said hearing, the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 26th day of .Tnnp , 19..1.3..-' and continued to the ---- day of ------- , 19 -- , as the time, and the City Council Chambers in the City Harr-Qf the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incor- poration thereof in the zone or zones hereinafter set forth, and did give notice thereof in the manner and form provided in said Title 18 of the Anaheim Municipal Code: and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and \iHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. .- NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: -1- 72-73-44 ,c,~ That portion of the Northeast quarter of the North- east quarter of Section 19, Township 4 South, Range 10 West, in the Rancho Los Coyotes, as shown on a Map recorded in Book 51, page 10 of Miscellaneous Maps, records of Orange County, California described as follows: Beginning at a point in the Easterly line of said Section 19, distant thereon South 00 12133 il East 759.00 feet from the Northeast corner of said Section, said point also being the most Northerly corner of the land described in the deed to Mary Mae Vander Boom recorded in Book 930, page 4 of Official Records of said Orange County; thence South 570 571 3811 West 205.98 feet along the Northwesterly line of said land to the Easterly line of Tract No. 2473, as shown on a Map recorded in Book 72, pages 27 and 28 of said Miscellaneous Maps; thence along said last mentioned Easterly line South 00 12' 3311 East 130.71 feet to the Northwesterly corner of the land described in deed to Louis G. Vander Boom and wife recorded May 26, 1959 in Book 4728, page 143 of said Official Records; thence along the Northerly line of said last mentioned land North 890 471 27" East 175.00 feet to said Easterly line of Section 19; thence along said last mentioned Easterly line North 00 12' 33" West 239.34 feet to the point of beginning. be excluded from R-A, AGRICULTURAL ZONE and incorporated in C-l, GENERAL COMt1ERCIAL ZONE, subject to the following conditions: 1. That the sidewalks and driveways shall be installed along Brookhurst Street as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer. 2. That street lighting facilities along Brookhurst Street shall be installed as required by the Director of Public Utilities and in accordance with standard plans and specifications on file in the office of the Director of Public utilities; and that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installa- tion of the above mentioned requirements. 3. That the owner(s) of subject property shall pay to the City of Anaheim the sum of 60 cents per front foot along Brookhurst Street for tree planting purposes. 4. That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works. 5. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. ",~- 6. That a six-foot masonry wall shall be constructed along the west property line. 7. That all air conditioning facilities shall be properly shielded from view, and the sound buffered from adjacent properties. -2- - 8. That any parking area lighting proposed shall be down-lighting of a maximum height of six feet, which lighting shall be directed away from the property lines to protect the residential integrity of the area. 9. That subject property shall be served by under- ground utilities. 10. That the final parking plan shall be approved by the Development Services Department, and any landscaped areas in the parking area shall be protected with six-inch high concrete curbs, and concrete wheel stops shall be provided for parking spaces. 11. That drainage of subject property shall be disposed of in a manner that is satisfactory to the City Engineer. 12. That IS-gallon trees planted on 20-foot centers with appropriate irrigation facilities shall be installed and maintained along the west property line. 13. Prior to the introduction of an ordinance rezoning subject property, Conditions Nos. 2 and 3, above mentioned, shall be completed. The provisions or rights granted by this resolution shall become null and void by action of the City Council unless said conditions are complied with within one year from the date hereof or such further time as the City Council may grant. 14. That Conditions Nos. 1, 4, 6, 7, 8, 9, 10, 11 and 12, above mentioned, shall be complied with prior to final building and zoning inspections. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare ~d submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
