1973-241 RESOLUTION NO. 73R-24l A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 2501. WHEREAS, after a request for variance by Peter and Dorine Cabrera, owners, was received, a public hearing before the Planning Commission of the City of Anaheim was held upon due and proper notice as a result of which Variance No. 2501 was denied covering the following described property: That portion of Lot 3 of Anaheim Extension, City of Anaheim, as shown on a map thereof, made by Wm. Hamel and filed for record in the office of the County Recorder of Los Angeles County, described as follows:- Beginning at a point in the Northerly line of said Lot 3, distant thereon South 890 51' 30" East 307.81 feet from the Northwesterly corner thereof, said point being also the Northeasterly corner of the land described in Certificate of Title No. 10,435, and running thence South 160 28' 30" East along the Easterly line of said land described in said Certificate of Title No. 10,435, a distance of 200 feet; thence Westerly at right angles to said last mentioned course 100 feet; thence North 160 28' 30" West to the North line of said Lot 3; thence South 890 51' 30" East along said North line to the point of beginning. EXCEPTING THEREFROM the Northerly 30 feet thereof included within La Palma Street. ~- WHEREAS, thereafter, within the time prescribed by law an interested party or the City Council on its own motion caused the review of said Planning Commission action at a pub- lic hearing noticed and held as prescribed by law and as a result thereof the City Council does hereby make the following findings: 1. That there are special circumstances applicable to the property, including size, shape, topography, location or surroundings, which do not apply to other property under identical zoning classifica- tion in the vicinity. 2. That, because of special circumstances shown in (1) above, strict application of the zoning code deprives the property of privileges enjoyed by other property under identical zoning classifica- tion in the vicinity. NOW I THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby, granted permitting the conversion of an existing single-family residence to a commercial office use with waivers of the following sections of the Anaheim Municipal Code: SECTION 18.40.070(2) (a)5a Required tree screen. Tree screen required adjacent to residen- tial boundary; none proposed. -1- SECTION 18.40.070(3) (a) Maximum building height within 150 feet of a residential zone. (9 feet allowed; 23 feet pro- posed) . .,- SECTION l8.40.070(6) (a) Required 6-foot solid masonry wall abutting a residential zone. (Masonry wall required; wood fence proposed). That said variance be granted subject to the following conditions: 1. That this Variance is granted subject to the com- pletion of Reclassification No. 72-73-43, now pending. 2. That subject property shall be developed substan- tially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 and 2. BE IT FURTHER RESOLVED that the City Council hereby reserves the right to revoke such variance for good cause or failure of said owners, their heirs, successors or assigns, to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term pre- scribed by the Anaheim Municipal Code unless otherwise speci- fied herein.
