RESOLUTION NO. 73R 226
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
COUNCIL OF THE CITY OF ANAHEIM APPROVING THE
TERMS AND CONDITIONS OF AN AGREEMENT WITH
SPIEGEL & McDIARMID, AND AUTHORIZING THE f1AYOR
AND CITY CLERK TO EXECUTE SAID AGREEMENT.
WHEREAS, the City presently purchases wholesale
power from the Southern California Edison Company (herein-
after referred to as liCOMPANYI') under rates, terms and
conditions adopted by the Company and approved by the
Federal Power Commission; and
WHEREAS, the Company has filed with the Federal
Power Commission an application for an increase in the rates
and charges of the rate schedule under which the City
purchases its wholesale electrical energy supply from Company;
and
WHEREAS, the City has determined that it is in its
best interests to oppose the application by the Company to in-
crease its rates charged to the City; and
~mEREAS, the City is interested in modifying its
power supply arrangements as economically feasible, so as to
be able to generate part or all of its requirements, to arrange
for transmission service by the Company, to participate in
joint power supply projects with the Company and others, and
make other such arrangements; and
WHEREAS, the City will require the services of expert
legal, engineering, analytical and other professional consult-
ants to assist in the foregoing matters; and
WHEREAS { the City of Anaheim and others are retaining
Spiegel & McDiarm~d to perform similar services as contemplated
herein; and
WHEREAS, City is of the opinion that it would be in
the best interests of City to hire Spiegel & McDiarmid to provide
legal services and assistance to City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the terms and conditions of an agree-
ment employing Spiegel & McDiarmid to provide legal services
and assistance to the City of Anaheim be, and the same are here-
by approved.
BE IT FURTHER RESOLVED, that the Mayor and City Clerk
are authorized to execute said agreement on behalf of the City
of Anaheim.
