A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING THE TERMS AND CONDITIONS
OF AN ENCROACHMENT PERMIT AND AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE SAID ENCROACH-
MENT PERMIT WITH FRANCHISE REALTY INTERSTATE
CORPORATION. (72-4E)
WHEREAS, Franchise Realty Interstate Corporation is
the owner of property in the City of Anaheim over which the
City owns an easement for public utility purposes; and
WHEREAS, Franchise Realty Interstate Corporation
wishes to use a portion of said easement to allow existing
planters and sign to encroach into a portion of newly dedicat-
ed ultimate right of way located on the north side of Ball
Road, west of Gilbert Street, in the City of Anaheim; and
WHEREAS, unless Franchise Realty Interstate Corpora-
tion is allowed to encroach upon the easement of the City, an
extreme and undue hardship will be caused to them; and
WHEREAS, the proposed encroachment to allow existing
planters and sign across a portion of the easement of City
will not interfere with the present use of the easement of the
City.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the terms and conditions of a
license agreement between the City of Anaheim and Franchise
Realty Interstate corporation be, and the same are, hereby
approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
are hereby authorized to execute said license agreement on
behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by
