1973-183 RESOLUTION NO. 73R-183 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 2490. WHEREAS, after a request for variance by Atlantic Richfield Co., lessee; P B R Company, agent, was received, a public hearing before the Planning Commission of the City of Anaheim was held upon due and proper notice as a result of which Variance No. 2490 was granted covering the following described property: The South 200.00 feet of the West 200.00 feet of the Southwest Quarter of Section 1, Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, as per map recorded in Book 51, Page 10 of Miscellaneous Maps, in the office of the County Recorder of said County. WHEREAS, thereafter, within the time prescribed by law an interested party or the City Council on its own motion caused the review of said Planning Commission action at a public hearing noticed and held as prescribed by law and as a result thereof the City Council does hereby make the following findings: 1. That there are special circumstances applicable to the property, including size, shape, topography, location or surroundings, which do not apply to other property under identical zoning classifica- tion in the vicinity. 2. That, because of special circumstances shown in (1) above, strict application of the zoning code deprives the property of privileges enjoyed by other property under identical zoning classifica- tion in the vicinity. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheun that a conditional zoning variance be, and the same is hereby granted permitting four (4) llself-serve" signs on the property hereinbefore described, with waivers of the following sections of the Anaheim Municipal Code: SECTION l8.62.090B(1) Maximum number of free-standing signs, (one sign permitted, four signs proposed) ,............-.. Minimum distance between free- standing signs. (300 feet required, 20 feet proposed) Minimum height of free-standing signs. (8 feet required, 8 inches proposed) That said variance be granted subject to the following condition: SECTION l8.62.090B(2) SECTION l8.62.090B(1) That subject property shall be developed sub- stantially in accordance with plans and speci- fications on file with the City of Anaheim marked Exhibits Nos. 1 and 2. -1- ~ BE IT FURTHER RESOLVED that the City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owner, its successors or assigns, to comply with the Anaheim Municipal Code and regulations and the condi- tions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein. THE FOREGOING RESOLUTION is approved and signed by me this 22nd day of May, 1973.
