WHEREAS, after a request for variance by ~~aheim Hills, Inc., owner, and James L. The side lines of said 36.00 foot strip of land shall be pro- longed or shortened at the beginning thereof so as to terminate in the Easterly boundary of the hereinabove described parcel of land. EXCEPTING that portion of the above described 36.00 foot strip of land within the above described 54.00 foot strip of land. WHEREAS, thereafter, within the time prescribed by law an interested party or the City Council on its own motion caused the review of said Planning Commission action at a public hearing noticed and held as prescribed by law and as a result thereof the City Council does hereby make the following findings: 1. That there are special circumstances applicable to the property, including size, shape, topography, location or surroundings, which do not apply to other property under identical zoning classifica- tion in the vicinity. 2. That, because of special circumstances shown in (1) above, strict application of the zoning code deprives the property of privileges enjoyed by other property under identical zoning classifica- tion in the vicinity. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim, that a conditional zoning variance be, and the same is hereby granted permitting the subdivision of the property hereinbefore described into 229 RS-5000 zoned lots in four tracts with waivers of the following Sections of the Anaheim Municipal Code: SECTION 18.26.050(1) (c) - Minimum lot width on cul-de-sac. (45 feet required; 40 feet pro- posed for one lot in Tract No. 8220) SECTION 18.26.050(3) - Maximum lot coverage. (35% permit- ted; 42% proposed) SECTION 18.26.050 (5) (a) Reauired setback between front pr~perty line and garage. (6 to 10 feet or 25 feet required; (3 to 5 feet and 10 to 25 feet pro- posed) SECTION 18.04.075 - Requirement that single-family residential structures rear on arterial highways. (3) - _. -5- ~- That said variance be granted subject to the following conditions: 1. That this variance is granted subject to the approval of Tentative Map of Tract Nos. 8220, 8221, 8222 and 8223 and the com- pletion of Reclassification No. 71-72-44. 2. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15 and 16; provided however, that final specific plans shall be submitted and approved in accordance with provisions of the PC, Planned Community, Zone prior to the approval of the final tract maps. BE IT FURTHER RESOLVED that the City Council hereby reserves the right to revoke such Variance permit for good cause or failure of said owner, his heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said Variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise speci- fied herein. THE FOREGOING RESOLUTION is approved and signed by me this 24th day of April, 1973.
