1973-159 RESOLUTION NO. 73R-lS9 ,- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIH FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. MIEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Pro- ceedings No. 7~-(3-36 to consider an amendment to Title 18 of the Anaheim Mun~c~pal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing, the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a reco~endation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 24th day of ~pril , 19~, and continued to the _____ day of ----------, 1 ___, as the time, and the City Council Chambers in the City Harr-Df the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incor- poration thereof in the zone or zones hereinafter set forth, and did give notice thereof in the manner and form provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and iv.HEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: -1- 72-73-36 PARCEL I: The West 198 feet of the following: -- Commencing at the Southeast corner of the Southeast quarter of the Northeast quarter of Section 22, in Township 4 South, Range 11 West, in the Rancho Los Coyotes, in the City of Anaheim, as shown on a map thereof recorded in book 51, page 7 of Miscellaneous Maps, records of said Orange County; thence running North 10 chains; thence West 12 chains; thence South 10 chains; and thence East 12 chains to the point of beginning. PARCEL II: Beginning at a point in the South line of the South one-half of the Southeast quarter of the Northeast quarter of Section 22, in Township 4 South, Range 11 West, in the Rancho Los Coyotes, in the City of Anaheim as shown on a map thereof recorded in book 51, page 7 of Miscellaneous Maps, records of said Orange County, 395.88 feet, more or less, East of the South- west corner thereof, said point also being the South- east corner of the tract of land conveyed to Robert L. Garlington and wife by deed dated June 10, 1947, and recorded June 25, 1947 in book 1529, page 385, of Official Records, in the office of the County Recorder of said Orange County; thence North parallel with the East line of said land conveyed to Garlington 660.43 feet to a point in the North line of said South one-half; thence East along said North line of the South one-half to the Northwest corner of the East 12 acres of the South one-half of the Southeast quarter of the Northeast quarter of Section 22, in Township 4 South, Range 11 West, San Bernardino Base and Meridian; thence South parallel with the West line of said East 12 acres 660 feet, more or less, to a point in the South line of said South one-half of the Southeast quarter of the North- east quarter of Section 22; thence West along said South line, 145.32 feet, more or less, to the point of beginning. ,~~ EXCEPT that portion of the South one-half of the South- east quarter of the Northeast quarter of Section 22, Township 4 South, Range 11 West, San Bernardino Base and Meridian in the Rancho Los Coyotes, in the City of Anaheim, as shown on a map thereof recorded in book 51, page 7 of Miscellaneous Maps, records of said Orange County, described as follows: Beginning at a point in the South line of the said South one-half 412.88 feet, more or less, East of the Southwest corner thereof, said point also being 17.00 feet East of the Southeast corner of the tract of land conveyed to Robert L. Garlington and wife by deed dated June 10, 1947, and recorded June 25, 1947 in Book 1529, at page 385 of Official Records, in the office of the County Recorder of said County; th~lce North parallel with the East line of said land conveyed to Garlington 165.00 feet; thence East parallel with said South line, 110.00 feet; thence South parallel with said East line of land conveyed to Garlington 165.00 feet to a point in said South line; thence West along said South line, 110.00 feet to the point of beginning. -2- PARCEL III: ,~ Beginning at a point in the South line of the South half of the Southeast quarter of the Northeast quarter of Section 22, Township 4 South, Range 11 West, S.B.B. & M. in the Rancho Los Coyotes, in the City of Anaheim as shown on a map thereof recorded in book 51, page 7 of Miscellaneous Maps, records of said Orange County, 263.92 feet East of the Southwest corner thereof, said point being the Southeast corner of Parcel 1 described in the deed to Victor Lee Dougless and wife, recorded May 13, 1947; thence North parallel with the West line of said South half, 660.26 feet to a point in the North line of said South half; thence East along said North line 131.81 feet; thence South parallel to the West line of said South half, 660.43 feet to a point in the South line thereof and thence West along said South line, 131.96 feet, more or less, to the point of beginning. EXCEPTING THEREFROM the following: Beginning at the Northwest corner of the above described parcel and running thence East along the North line thereof 25 feet; thence South parallel with the West line of said South half, 34 feet; thence West parallel with the South line of said South half, 25 feet to a point in the West line of the above described parcel; thence North along the West line of said Parcel, 34 feet to the point of beginning. PARCEL VII: The East 132 feet of the West 330 feet of tiLe following: - Commencing at the Southeast corner of the Southeast quarter of the Northeast quarter of Section 22, in Town- ship 4 South, Range 11 West, in the Rancho Los Coyotes, in the City of Anaheim, as shown on a map thereof recorded in book 51, page 11, Miscellaneous Maps, records of said Orange County, and running thence North 10 chains; thence West 12 chains; thence South 10 chains; thence East 12 chains to the point of beginning. -4- PARCEL VIII: -" Beginning at a point on the South line of the Northeast quarter of Section 22, in Township 4 South, Range 11 West, San Bernardino Base and Meridian, in the City of Anaheim, distant Westerly 334 feet from the Southeast corner of the Northeast quarter of said section, and running thence North 00 14' son West, parallel with the East line of said Northeast quarter, 184 feet; thence Westerly parallel with the South line of said Northeast quarter 29 feet; thence North 00 14' 50" West, parallel with the East line of said Northeast quarter 210.5 feet to the South line of the North 265.5 feet of the South 10 chains of said Northeast quarter; thence West along said South line 99 feet to the East line of the West 330 feet of the East 12 chains of said Northeast quarter; thence South along said East line 394.5 feet to the South line of said Northeast quarter; thence East along said South line 128 feet to the point of beginning. be excluded from R-A, AGRICULTURAL ZONE, and incorporated in R-3, MULTIPLE-FAMILY RESIDENTIAL ZONE, subject to the following conditions: 1. That a final tract map of subject property shall be submitted to and approved by the City Council and then be recorded in the office of the Orange County Recorder. 2. That the completion of these reclassfication proceedings is contingent upon the granting of Variance No. 2487 and Tentative Map of Tract No. 8204. 3. That the owners of subject property shall pay to the City of Anaheim the appropriate park and recreation in-lieu fees as determined to be appropriate by the City Council, said fees to be paid at the time the building permit is issued. 4. That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works. 5. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. 6. That a 6-foot masonry wall shall be constructed along the north property line adjacent to the R-l parcels. 7. Prior to the introduction of an ordinance rezoning subject property, Condition No.1, above mentioned, shall be completed. The provisions or rights granted by this resolution shall become null and void by action of the City Council unless said condition is complied with within one year from the date hereof or such further time as the City Council may grant. - 8. That Conditions Nos. 4, 5, and 6, above mentioned, shall be complied with prior to final building and zoning inspections. -5- - BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
