RESOLUTION NO. 73R-6lS
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AUTHORIZING THE COMPROMISE OF CER-
TAIN EMINENT DOMAIN LITIGATION (Huarte Inverse
Condemnation)
~mEREAS, heretofore, on the 11th day of August, 1973,
Joseph D. and Dorothy C. Huarte filed in Superior Court Action
No. 194955, an action in Inverse Condemnation against the City
of Anaheim; and
WHEREAS, the City Council finds that the fair and
reasonable value of the property taken by the City amounts to
$2,000.00 and that it would be in the best interests of the City
to settle said litigation for said amount; and
WHEREAS, Plaintiffs, Joseph D. and Dorothy C. Huarte
have indicated their willingness to accept said $2,000.00 as
full settlement of said litigation and has offered to furnish
to the City of Anaheim their Easement Deed covering the pro-
perty involved.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that it compromise the hereinbefore described
inverse condemnation litigation for the sum of $2,000.00.
BE IT FURTHER RESOLVED that the Finance Director of
the City of Anaheim be, and he is hereby authorized and directed
to draw a City Warrant in the amount of $2,000.00 in favor of
Joseph D. Huarte and Dorothy C. Huarte, husband and wife, and
that he be directed to forward the same to the Office of the City
Attorney for transmittal.
THE FOREGOING RESOLUTION is approved and signed by me
this 26th day of December , 19 73 .
