RESOLUTION NO. 73R-~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHED~ AUTHORIZING AND DIRECTING Tilli MAYOR AND CITY CLERK TO EXECUTE A QUITCLAIM DEED IN FAVOR OF THE ORANGE COUNTY FLOOD CON- TROL DISTRICT. WHEREAS, the City of Anaheim desires the Orange County Flood Control District to assume the City's responsibility for the operation and maintenance of Deerfield Channel, located between the Riverside Freeway and the Santa Ana River Channel in the City of Anaheim; and WHEREAS, the Orange County Flood Control District pro- poses to accept a quitclaim deed which transfers the City's rights in Deerfield Channel to the District, and to assume the City's responsibility for the operation and maintenance of the channel facility; and WHEREAS, the Government Code of the State of California, Section 65402, provides in part that a local agency such as the flood control district shall not acquire real property nor dis- pose of any real property, nor construct a public building or structure in any county or city, until the location, purpose and extent of such activity has been reported upon as to conformity with the adopted general plan applicable thereto; and WHEREAS, Section 21151 of tile California Public Resources Code provides in part that a local agency, such as the flood con- trol district, shall make an environmental impact statement for any project which may have a significant effect upon the environ- ment; and \mEREAS, the proposed acquisition by the District has been reviewed by the City of Anaheim Planning Conuuission within the context of Section 21151 of the California Public Resources Code and Section 65402 of the California Government Code, said Planning Commission, having passed its Resolution PC73-80, on the 16th day of April, 1973, in which it did find that the pro- posed acquisition by the Orange County Flood Control District is in conformance with the City's adopted General Plan and will have no significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the Mayor and City Clerk be, and they are hereby authorized and directed to execute a quitclaim deed on behalf of the City of Anaheim in favor of the Orange County Flood Control District covering a portion of the facility known as the Deerfield Storm Channel. _...-'~ AND BE IT FURTHER RESOLVED that the City Council does find that the proposed acquisition by the District covered in said quitclaim deed is in conformance with the City's adopted General Plan and will have no significant effect on the environ- ment. -1- THE FOREGOING RESOLUTION is approved and signed by me this 20th day of November , 1973.
