1973-531 ~~ RESOLUTION NO. 73R- 531 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING RATES, RULES AND REGULA- TIONS FOR THE SALE AND DISTRIBUTION OF ELEC- TRIC ENERGY AS ADOPTED BY RESOLUTION NO. 7lR-478 AND AHENDED BY RESOLUTIONS NOS. 73R-25 N~D 73R-373. WHEREAS, the City of Anaheim does distribute electric energy to certain customers who live in Anaheim; and WHEREAS, all electric energy distributed by the City of Anaheim is purchased from the Southern California Edison Company; and WHEREAS, the Southern California Edison Company, on September 7, 1973, increased its wholesale electric rate 52.5% to cities such as Anaheim; and WHEREAS, the City Council determined that Anaheim's retail electric rates should be increased in an amount not to exceed Edison's retail rates in nearby communities effective September 7, 1973, to provide most of the funds for the addi- tional appropriation required for purchased power in the elec- tric utility budget; and ~VHEREAS, it was intended that Anaheim's rate increase in effect since September 7, 1973, be an interint increase effective until Edison's request for a general increase on all their retail electric rates was settled by the California Pub- lic utilities Commission (CPUC); and WHEREAS, the CPUC approved new Edison retail electric rates effective October 10, 1973; and WHEREAS, final Anaheim retail electric rates designed to recover the full amount of Edison's wholesale increase in the current fiscal year as well as revenue lost during the interim period can now be made effective without exceeding Edison's retail rates charged in nearby communities; and -- WHEREAS, an additional appropriation of $90,000 is required for the San Joaquin Nuclear Project Study; and WHEREAS, the City Council has determined that Anaheim's retail electric rates shall be increased to recover during the current fiscal year the full amount of Edison's wholesale increase as well as revenue lost during the interim period and to provide funds for the additional appropriation for the San Joaquin Nuclear Project Study; and MfEREAS, Rule No. 17 contained in Resolution No. 7lR-478 provides guidelines for use in correcting electric bills for meter error (physical malfunction) but is silent in regard to billing corrections necessitated by clerical or other utility-caused error; and WHEREAS, the City Council has further determined that in no case shall a billing correction for an under- charge be rendered for a period exceeding four months. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the rates, rules and regulations adopted by Resolution No. 7lR-478 and w~ended by Resolutions Nos. 73R-2S and 73R-373 be, and the same is hereby amended as follows, to wit: ,J'-"~. C. Whenever, upon test, equipment under normal operating condi- tion is found to be delivering more than 125 per cent of its capacity as indicated by its nameplate rating, the City may disregard the nameplate rating and base its charges upon the output as calculated from test. Equipment which is billed on a basis in excess of its nameplate rating in accordance with. this special condition shall be tested upon notification by the consumer of a permanent change in operating conditions. The agricultural year upon which this rate is based shall consist of twelve consecutive months, the start of the first month being the first regular meter reading taken during the month of May and the end of the last month being the last regular meter reading taken during the month of April of the succeeding year. C. The service charge is payable in six monthly installments during the months of May to October inclusive. Consumers, whose normal use of energy does not occur within the period May through October, may elect, if satisfactory to the City of Anaheim, another six months within which to pay the service charge, provided such period shall not begin later than the month of October. TESTS RULE NO. 17 METER TESTS AND ADJUSTMENT OF BILLS FOR ERRORS 1. On Customer Request.' A customer may, on notice of not less than one week, require the Utility to test the meter for his service. No charge will be made for such test, but, should a cus- tomer da~and a test within six months after installation or more often than once in six months, he will be requirec to deposit $2.50 to pay, in part, the cost of the test. This deposit will be returned if the meter is found to register more than 2% fast or 2% slow. A customer shall have the right to require the utility to conduct the test in his presence or in the presence of an expert or other representative appointed by him. The results of the test will be furnished to the customer within a reasonable time after completion of the test. B. ADJUSTMENT OF BILLS FOR rffiTER ERROR. 1. ,.,"~.'" Fast Meters. When, upon test, any meter is found to be registering more than 2% fast, the Utility will refund to the customer the amount of tiLe overcharge based on cor- rected meter readings for the preceding six months, sub- ject to the provisions of paragraph 4 hereof. 2. Slow Meters. When, upon test, any meter for domestic service is found to be registering more than 25% slow, or any meter for other class of service is found to be registering more than 2% slow, the utility may bill the customer for the amount of the undercharge based on cor- rected meter readings for the preceding four months, subject to the provisions of paragraph 4 hereof. 3. Nonregistering Meters. When, upon test, any meter is found to be nonregistering, the Utility may bill the customer for the estimate of electricity consumed but not registered for a period of four months, subject to the provisions of paragraph 4 hereof. Bills for this purpose will be estimated from the cus- tomer's prior use, the customer's subsequent use correctl metered, the Utility's experience with other customers of the same class, and the general characteristics of the customer's operation.
