1973-525 RESOLUTION NO. 73R-525 ""..,........,\ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF l\NAIIEHl FINDING AND DETERMINING THAT TITLE 18 OF THE AnAHEIH MUNICIPAL CODE RELATING TO ZONING SHOuLD BE AMENDED AND THAT THE BOUND- ARIES uF CERTAIN ZONES SHOULD BE CHANGED. MIEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Pro- ceedings No. 73-74-23 to consider an amendment to Title 18 of the Anaheim Municipai Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter nentioned and described, and at said hearing did receive evidence and reports from persons interested therein' and from its staff; and WHEREAS, within a period of forty days following said hearing, the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEHEAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planni:1q Commission the City Council did fix the 6th day of November, 19 73 , and continued to the day of , 19 , as the time, and the City Council Chambers in the City Harr-Df the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incor- poration thereof in the zone or zones hereinafter set forth, and did give notice thereof in the manner and form provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its ~eport of findings and recommendation; and \ffiEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property herainafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. - NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: -1- ..,..,,-.,...., That portion of Lot 25 of Anaheim Extension, as shown on a map survey by William Hamel, a copy of which is shown in book 3, pages 162 to 164 inclu- sive of "Los Angeles County Maps", in the office of the County Recorder of said Orange County, described as follows: Beginning at the Southeast corner of Lot 2 of Tract No. 1379, as shown on a map recorded in book 43, pages 6 and 7 of Miscellaneous Maps, records of said Orange County; thence along the Southerly pro- longation of the Easterly line of said Lot 2 South l5Q 32' 15" East 122.00 feet to the Southerly line of that certain land described in deed to Hulen E. Slayton and wife, recorded September 11, 1948 in book 1699, page 191 of Official Records of said Orange County; thence along said Southerly line North 740 13' 4511 East 152.61 feet to the Southwest- erly corner of that certain land described in deed to Donald Thompson and wife, recorded February 7, 1966 in book 7833, page 31 of said Official Records; thence along the Westerly line of said last mention~ ed land North 150 32' ISH West 99.73 feet to the Northwesterly corner thereof; thence along the West- erly prolongation of the Northerly line of said land South 740 27' 4511 West 22.00 feet to the intersec- tion with the Southerly prolongation of the Easterly line of Lot 3 of said Tract No. 1379; thence along said last mentioned prolongation North 150 32' IS" West 22.18 feet to the Southeasterly corner thereof; thence along the Southerly line of said Lot 3 and the Westerly prolongation thereof South 740 13' 45" West 131.46 feet to the Point of Beginning. be excluded from R-l SINGLE FAMILY RESIDENTIAL ZONE, and incorporated in C-l GENERAL COMMERCIAL ZONE, subject to the following conditions: 1. That the owner(s) of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot along Charlotte Avenue and Claudina Street for street lighting purposes. - 2. That the owner(s) of subject "property shall pay to the City of Anaheim the sum of 60~ per front foot along Charlotte Avenue and Claudina Street for tree planting purposes. 3. That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works, and shall be relocated away from the single family residence to the east. 4. That all air conditioning facilities shall be properly shielded from view, and the sound buffered from adjacent properties. S. That subject property shall be served by under- ground utilities. 6. That a 6-foot masonry wall shall be constructed along the east property line and south property line adjacent to Claudina Street. -2- .- 7. That drainage of subject property shall be dis- posed of in a manner satisfactory to the City Engineer. 8. That the final parking plan shall be approved by the Development Services Department, and any landscaped areas in the parking areas shall be protected with 6-inch high, concrete curbs, and concrete wheel stops shall be provided for parking spaces. 9. That a S-foot landscape buffer strip shall be provided along the east property line separating and protecting the single family residence from odors and noises emanating from the parking area. 10. That subject property shall be developed sub- stantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit NO.1, provided, however, that a 6-foot wall or crash gate shall be constructed at the exit to Claudina Street. 11. Prior to the introduction of an ordinance rezon- ing subject property, Conditions Nos. 1 and 2, above mentioned, shall be completed. The provisions or rights granted by this resolution shall become null and void by action of the City Council unless said conditions are complied with within one year from the date hereof, or such further time as the City Council may grant. 12. That Conditions Nos. 3, 4, 5, 6, 7, 8, 9, and 10 above mentioned, shall be complied with prior to final building and zoning inspections. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to -the City Council an ordinance amending Title l80f the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
