1973-524 RESOLUTION NO. 73R-524 "- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEU1 FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Pro- ceedings No. 73-74-10 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from 1ts staff; and WHEREAS, within a period of forty days followinq said hearing, the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 6th day of November, 1973 , and continued to the day of , 19 , as the time, and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incor- poration thereof in the zone or zones hereinafter set forth, and did give notice thereof in the manner and form provided in said Title 18 of the Anaheim Municipal Code; and 'V:HEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. <",,..-.. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: 73-74-10 -1- PORTION NO.3. ,~.............. That portion of the Southeast quarter of Section 7, Township 4 South, Range 10 West, S.B.B. & M., described as follows:' .- Beginning at the southeast corner of the Southeast quarter of said Section 7, said corner being the centerline intersection of Lincoln Avenue and Brook- hurst Street; thence N 00 16' 10" W, 350.19 feet; thence S 890 36' 20" W, 144.00 feet to the southeast corner of Lot 44 in Tract No. 1633, as shown on a map recorded in Book 47, page 50, Miscellaneous Maps, records of Orange County, California; thence S 780 38' 32" W, 81.45 feet to the intersection with the southerly right of way line of Ranchito Street; thence Southeasterly, Southerly, Southwesterly, Westerly and Northwesterly along said right of way line along a curve concave northwesterly and having a radius of 50 feet, through a central angle of 1420 22' 23" an arc distance of 124.24 feet to the begin- ning of a reverse curve concave southwesterly and having a radius of 50 feet, a radial line bearing N 410 0' 35" E passes through said point of beginning of reverse curve; thence Northwesterly and westerly along said reverse curve through a central angle of 410 24' 35" an arc distance of 36.14 feet to an intersection with a line parallel with and 25 feet southerly of the centerline of said Ranchito Street; thence S 890 36' 20'1 W, 148.95 feet tangent to the last mentioned curve to the beginning of a tangent curve concave southeasterly and having a radius of 18 feet; thence Westerly, Southwesterly and Southerly along the last mentioned curve through a central angle of 890 52' 30" an arc distance of 28 feet to an intersection with a line parallel with and 25 feet easterly of the centerline of Kathryn Drive; thence S 00, 16' 10" E, 20 feet, more or less, to an intersection with the easterly prolongation of the south line of Lot 3 in said Tract 1633; thence S 890 34' 20" W, 154.27 feet to the southwest corner of Lot 3 in said Tract 1633; thence S 00 16' 10" E, 260.00 feet, more or less, to an intersection with the centerline of Lincoln Avenue; thence N 890 34' 20'1 E, 660.26 feet to the point of beginning. Excepting therefrom any portion thereof lying within Lincoln Avenue and Brookhurst Street. be excluded from R-A, AGRICULTURAL ZONE and incorporated in C-3, HEAVY COMMERCIAL ZONE, subject to the following conditions. 1. That the sidewalks shall be installed along the west side of Kathryn Drive as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer. 2. That the owner(s) of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot along Kathryn Drive, Brookhurst Street and Lincoln Avenue for street lighting purposes. -2- - 3. That the owner(s) of subject property shall pay to the City of Anaheim the sum of 60 cents per front foot along Kathryn Drive, Brookhurst Street and Lincoln Avenue for tree planting purposes. 4. That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works. s. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department. 6. That a six-foot masonry wall shall be constructed along the north property lines except where abutting other C-l property. 7. That all air conditioning facilities shall be properly shielded from view, and the sound buffered from adjacent properties. 8. That an~ parking area lighting proposed shall be down-lighting of a maxJ.mum height of six feet, whicb'lighting shall be directed away from the property lines to protect the residential integrity of the area. 9. That drainage of subject property shall be disposed of in a manner that is satisfactory to the City Engineer. 10. Subject property shall be developed in conformance with the site development standards of the C-l Zone. 11. Prior to the introduction of an ordinance rezoning subject property, Conditions Nos. 2 and 3, above mentioned, shall be completed. The provisions or rights granted by this resolution shall become null and void by action of the City Council unless said conditions are complied with within one year from the date hereof or such further time as the City Council may grant. 12. That Conditions Nos. 1, 4, 5, 6, 7, 8, 9 and 10, above mentioned, shall be complied with prior to the issuance of a building permit where existing structures are being modified; or prior to final building and zoning inspection where new construction is proposed or where existing structures are removed to make way for new construction. ,...---. BE IT FURTfillR RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
