1973-523 RESOLUTION NO. 73R-S23 ,- A RESOLU'I'ION OF TIlE CITY COUNCIL OF THE CITY OF ANAIIEIi; FINDING AND DETERIvtINIUG THAT TITLE 18 OF THE ANAHEH1 HUNICIPAL CODE RELATING TO ZONING SHOULD BE AM.ENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. MIEREAS, the City Planning Commission of the City of Anaheim d1d hold a public hearing in Reclassification Pro- ceedings No. 73-74-9 to consider an amendment to Title 18 of the Anaheim Municipai-c!ode relating to zoning, and to consider a change in the bounc1aries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff~ and MIEREAS, within a period of forty days following said hearing, the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth: and WHEHEAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City P1anninq Commission the City Council did fix the 6th day of --Hovembec 19~, and continued to the day of , l~ ,as the time, and the City Council Chambers in the City Iiarr-Df the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incor- poration thereof in the zone or zones hereinafter set forth, and did give notice thereof in the manner and form provided in said Title 18 of the Anaheim Municipal Code: and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presonted at said public hearing before the Planning Commission, its ~eport of findings and recommendation; and \fflEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property her2inafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. ,.~"-"'" NOW, THEREFORE, BE IT P~SOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: 73-74-9 -1- PORTION 2: - That portion of the Southeast quarter of section 7, Township 4 South, Range 10 West, S.B.B. & M., described as follows: Beginning at the southwest corner of Lot 45 in Tract 1633, as shown on a map recorded in Book 47, page 50, Miscellaneous Maps, records of Orange County, California; thence N 00 16' lOll W, 350.00 feet to the southwest corner of Lot 12 in Tract 1569, as shown on a map recorded in Book 47, page 17, Miscellaneous Maps, records of said Orange County; thence 00 16' 10" W, 515.00 feet to an intersection with the centerline of Woodley Avenue; thence N 890 36' 20" W, 30 feet, more or less, to an intersection with the southerly prolongation of the west line of Lot 4 in said Tract 1569; thence N 00 16' 10" W, 133.00 feet to the north line of said Tract 1569; thence S 890 36' 20" E, 114.00 feet to an intersection with a line parallel with and 60.00 feet westerly of the centerline of Brookhurst Street; thence S 00 16' 10" W, 998 feet, more or less, to an intersection with the south line of Lot 45 in said Tract 1633; thence S 890 36' 20" W, 84.00 feet, more or less, to the point of beginning. And further, that portion of the Southwest quarter of Section 8, Township 4 South, Range 10 West, S.B.B. & M., described as follows: _. Beginning at the southwest corner of Lot 9 in Tract 1851, as shown on a map recorded in Book 56, pages 25 and 26, Miscellaneous Maps, records of Orange County; thence N 00 16' 10" W, 760 feet, more or less, to the southwest corner of Lot 8 in Tract 2587, as shown on a map recorded in Book 80, page 41, Miscellaneous Maps, records of said Orange County; thence N 00 10' 1011 W, 70.00 feet to the northwest corner of said Lot 8; thence N 890 31' W 2.90 feet; thence N 00 16' 10" W, 70.00 feet; thence S 690 31' 07" E, 29 feet; thence N 00 16' 10" W' 85.60 feet to an intersection with the westerly prolongation of the north line of said Tract 2587; thence N 890 3111 '\1, 116 feet, more or less, to an intersection with a line parallel with and 60 feet easterly of the centerline of Brookhurst Street; thence S 00 16' 100 E, 970 feet, more or less, along said parallel line to an intersection with the westerly prolongation of the south line of Lot 9 in said Tract 1851; thence S 890 31' E, 87.00 feet, more or less, to the point of beginning. be excluded from R-A, AGRICULTURAL ZONE and incorporated in C-l, GENERAL COMMERCIAL ZONE, subject to the following conditions: 1. That the sidewalks shall be installed along Brookhurst Street as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer. -2- 2. That the owner(s) of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot along Brookhurst street for street lighting purposes. 3. That the owner(s) of subject property shall pay to the City of Anaheim the sum of 60 cents per front foot along Brookhurst Street for tree planting purposes. 4. That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works. 5. That fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department. 6. That a six-foot masonry wall shall be constructed along all boundaries separating C-l and R-l properties. 7. That all air conditioning facilities shall be properly shielded from view, and the sound buffered from adjacent properties. 8. That any parking area lighting proposed shall be down-lighting of a maximum height of six feet, which lighting shall be directed away from the property lines to protect the residential integrity of the area. 9. That the final parking plan shall be approved by the Development Services Department, and any landscaped areas in the parking area shall be protected with six-inch high concrete curbs, and concrete wheel stops shall be provided for parking spaces. 10. That drainage of subject property shall be disposed of in a manner that is satisfactory to the City Engineer. 11. Prior to the introduction of an ordinance rezoning subject property, Conditions Nos. 2 and 3, above mentioned, shall be completed. The provisions or rights granted by this resolution shall become null and void by action of the City Council unless said conditions are complied with within one year from the date hereof or such further time as the city Council may grant. 12. That Conditions Nos. 1, 4, 5, 6, 7, 8, 9 and 10, above mentioned, shall be complied with prior to the issuance of a building permit where existing structures are being modified; or prior to final building and zoning inspection where new construc- tion is proposed or where existing structures are removed to make way for new construction. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper. ~~- -3- THE FOREGOING RESOLUTION is approved and signed by me this 6th day of November, 1973.
