RESOLUTION NO. ?3R-S22 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAIIEIN FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIr-1 MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. miEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Pro- ceedings No. 73-74-1 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff~ and ffilEREAS, within a period of forty days following said hearing, the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 6th day of ~vember, 19.J.L, and continued to the --- day of -------, 1 __, as the time, and the City Council Chambers in the City HaITOf the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incor- poration thereof in the zone or zones hereinafter set forth, and did give notice thereof in the manner and form provided in said Title 18 of the Anaheim Municipal Code~ and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation~ and 'VHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. '- /- NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: -1- 73-74-1 PORTION I-a: That portion of the Southeast quarter of Section 7, Township 4 South, Range 10 West, S.B.B. & M., des- cribed as follows; Beginning at the southwest corner of Lot 3 in Tract No. 1633, as shown on a map recorded in Book 47, page 50, Miscellaneous Maps, records of Orange County, California; thence N 09 161 20" W, 1,188.58 feet along the west line of said Tract 1633 to the northwest cor- ner thereof; thence N 890 36' 20" E, 330.00 feet; thence S 00 161 2011 E, 100.00 feet to an intersection with the north line of Lot 1 in Tract 1569, as shown on a map recorded in Book 47, page 17, Miscellaneous Maps, records of said Orange County; thenceN 890 36' 20" E, 156.39 feet to the northeast corner of Lot 3 in said Tract 1569; thence S 00 16' 10" W, 125.00 feet along the east line of said Lot 3, and the southerly prolongation thereof to an intersection with the center- line of Woodley Avenue; thence S 890 36' 2011 E, 30 feet, more or less, to an intersection with the northerly pro- longation of the westerly line of Lot 6 in said Tract 1569; thence S 09 161 10" E, 515 feet, more or less, along said prolongation and west line of said Lots 6 through 12, all of said Tract 1569, to the northeast corner of Lot 40 in the aforementioned Tract 1633; thence S 09 161 lOTI E, 350 feet along the east line of said Lots 40 through 44, all of said Tract 1633, to the southeast corner of said Lot 44; thence S 780 38' 3211 W, 81.45 feet to the southwest corner of said Lot 44; thence northwesterly in a direct line to the southeast corner of Lot 35 in said Tract 1633; thence S 890 36' 20" W, 215.04 feet to an intersection with the center- line of Kathryn Drive; thence S 00 16' 10" E, 95 feet, more or less, to an intersection with the easterly pro- longation of the south line of Lot 3 in said Tract 1633; thence S 890 34' 30" W, 129.28 feet to the point of beginning. PORTION l-b: That portion of the Southwest quarter of Section 8, Township 4 South, Range 10 West, S.B.B. & M., described as follows: Beginning at the southwest corner of Lot 9 in Tract 1851, as shown on a map recorded in Book 56, pages 25 and 26, Miscellaneous Maps, records of Orange County, California; thence N 00 16' 10" W, 760 feet, more or less, to the southwest corner of Lot 8 in Tract 2587, as shown on a map recorded in Book 80, page 41, Miscellaneous Maps, records of Orange County; thence N 00 10' 10" W, 70.00 feet to the northwest corner of said Lot 8; thence N 890 31' W, 2.90 feet; thence N 00 16' 10" W, 70.00 feet; thence S 690 31' 07" E, 29 feet; thence N 00 16' 10" W, 85.60 feet to an intersection with the westerly prolongation of the north line of said Tract 2587; thence -2- S 890 31' 00" E, 490.00 feet, more or less, along said prolongation and said northerly line to the northeast corner of said Tract 2587; thence S 00 16' 10" E, 1,100.00 feet, more or less, to the southeast corner of Lot 66 in the aforementioned Tract No. 1851; thence N 890 31' W, 131.70 feet to an intersection with the centerline of Lindsay Street; thence N 00 16' 10" W, 50.00 feet to an intersection with the easterly prolongation of the south line of Lot 34 in said Tract 1851; thence N890 31' W, 233.80 feet to an intersection with the centerline of Bircher Street; thence N 00 16' 10" W, 68.69 feet to an intersection with the easterly prolongation of the south line of Lot 9 in said Tract 1851; thence N 890 31' W, 132 feet, more or less, to the point of beginning. be excluded from R-A, AGRICULTURAL ZONE, and incorporated in R-l, SINGLE-FAMILY RESIDENTIAL ZONE. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
