RESOLUTION NO. 73R- 513
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEll1 REJECTING ALL BIDS SUBMITTED ON
WORK ORDER 2067; DETERMINING THE WORK MAY BE
PERFORMED MORE ECONOMICALLY BY THE CITY AND
DECLARING THE nmmDIATE NECESSITY OF SUCH
PROJECT FOR THE PRESERVATION OF PROPERTY.
WHEREAS, in connection with an advertisement for bids
on Work Order 2067 covering two check dams and a reinforced
concrete box in the Walnut Creek Channel, the City Engineer's
estimate was $72,222.20; and
WHEREAS, in response to said request for bids, the
lowest responsible bid was in excess of $126,000; and
WHEREAS, the estimate of said lowest responsible bidder
for the construction of the two check dams, considered by the
office of the City Engineer to be of in~ediate necessity for the
preservation of property, was in excess of $50,000; and
WHEREAS, the City Council finds and determines the work
considered to be of irr~ediate necessity may be performed more
economically by the City with its own employees; and
WHEREAS, the City Council finds and determines that the
construction of said two check dams are of immediate necessity,
in contemplation of the oncoming rainy season, for the preserva-
tion of property, bot~ City and privately owned~
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that all bids heretofore submitted on Work
Order 2067 be, and they are hereby rejected.
BE IT FURTHER RESOLVED that the construction of two
check dams, as more specifically set forth in the plans and spe-
cifications for said Work Order 2067, be constructed by the City
with its own employees and that no further notice requesting bids
on the same be published.
BE IT FURTHER RESOLVED that the City declare, and it
does hereby declare, that it deems the immediate construction and
completion of said two check dams to be of irr~ediate necessity
for the preservation of property.
AND BE IT FURTHER RESOLVED that the appropriate City
departments proceed immediately under the direction of the City
Manager to construct and cornplete said check dams in accordance
with the plans and specifications for the same on file in the
office of the City Engineer.
