RESOLUTION NO. 73R- ~
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANNiEIM APPROVING THE TERMS AND CONDITONS
OF AN ENCROACHMENT PERMIT AND AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE SAID ENCROACH-
MENT PERMIT WITH DR. JAMES W. CUMMINS AND
RELA1~D M. CUMMINS. (73-l0E)
~iHEREAS, Dr. James W. Cummins and Reland M.
Cummins, (husband and wife), hereinafter referred to as
Licensees, are the owners of property in the City of Anaheim
over which the City owns a ~ublic utility easement; and
WHEREAS, Licensees wish to encroach upon a
portion of said easement for the purpose of allowing expan-
sion of existing garage to encroach into easement of City;
and
lVHEREAS, unless Licensees are allowed to encroach
upon the easement of the City, an extreme and undue hardship
will be caused to them; and \ c
WHEREAS, the proposed encroachment for such instal~
lation across a portion of the easement of City will not
interfere with the present use of the easement by the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the terms and conditions of a
license agreement between the City of Anaheim and Dr. James W.
Cummins and Reland M. Cummins be, and the same are hereby
approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be and they are authorized to execute said license agreement
for and on behalf of the City of Anaheim.
