RESOLUTION NO. 73R-430
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING THE TERMS AND CONDITIONS
OF AN ENCROACID1ENT PERMIT AND AUTHORIZING THE
MAYOR AND CITY CLERK TO EXECUTE SAID ENCROACH-
MENT PERMIT WITH ANAHEIM HILLS, INC. AND TEXACO
VENTURES, INC. (73-SE)
WHEREAS, Anaheim Hills, Inc., a California corporation
and Texaco Ventures, Inc., a Delaware corporation, hereinafter
referred to as Licensees, are the owners of property in the
City of Anaheim over which the City has a service road and
public utility easement located south of Santa Ana Canyon Road,
west of Anaheim Hills Road, north of Nohl Ranch Road; and
WHEREAS, Licensees wish to encroach upon a portion of
said easement for the purpose of permitting motor vehicle access,
parking, roof overhang and landscaping for a private tennis club;
and
WHEREAS, unless Licensees are allowed to encroach upon
the easement of the City, an extreme and undue hardship will be
caused to them; and
WHEREAS, the proposed encroachment for such installa-
tion across a portion of the easement of City will not interfere
with the present use of the easement by the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the terms and conditions of a licens~
agreement between the City of Anaheim and Anaheim Hills, Inc.
and Texaco Ventures, Inc. be, and the same are h~reby approved.
BE IT FURTHER RESOLVED ~~at the Mayor and City Clerk
be, and they are hereby authorized to execute said license agree-
ment for and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by me
this 25th day of September, 1973.
