A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM APPROVING AN AMENDMENT TO CERTAIN
CONDITIONS OF APPROVAL IN RECLASSIFICATION
NO. 90-91-1 AND CONDITIONAL USE PERMIT NO. 3299
AND AMENDING RESOLUTIONS NO. 90R-312 AND
90R-313.
WHEREAS, the City Council of the City of Anaheim
heretofore adopted Resolution No. 90R-312 approving
Reclassification No. 90-91-1, and Resolution No. 90R-313 approving
Conditional Use Permit No. 3299, subject to certain conditions
specified therein; and
WHEREAS, the permittee has now requested an amendment to
certain of said conditions of approval; and
WHEREAS, the City Council held a duly noticed public
hearing on December 18, 1990, at which hearing the City Council did
receive and consider evidence, both oral and documentary, relating
to said request; and
WHEREAS, the City Council hereby finds and determines
that the amendment of said conditions of approval in the manner
hereinafter set forth is reasonably necessary to protect the public
peace, health, safety or general welfare, or necessary to permit
reasonable operation under said Reclassification and Conditional
Use Permit.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that the conditions of approval heretofore imposed
in Reclassification No. 90-91-1 be, and the same are hereby,
amended by the deletion of Condition No. 1 therefrom and the
amendment of Condition No. 6 thereof, as set forth in Resolution
No. 90R-312 to read as follows:
"That prior to introduction of an ordinance
rezoning subject property, Condition Nos. 2
through 5, above-mentioned, shall be completed.
The provisions or rights granted by this
resolution shall become null and void by action
of the City Council unless said conditions are
complied with within one (1) year from the date
of this resolution, or such further time as the
City Council may grant."
BE IT FURTHER RESOLVED that the conditions of approval
heretofore imposed in Conditional Use Permit No. 3299 as set forth
in Resolution No. 90R-313 be, and the same are hereby, amended by
the amendment of Condition Nos. 9 and 24, respectively, to read as
follows:
RECI2~SS 90-91-1
"9. That, excluding the street widths which
shall be as shown on Exhibit No. 1, all private
streets shall be developed in accordance with
Engineering Standard Detail No. 122 for private
streets, including installation of street name
signs. Plans for private street lighting, as
required by the Detail, shall be submitted to
the Building Division for approval and shall be
included with the building plans prior to
issuance of building permits."
"24. That prior to issuance of a building
permit or within a period of one (1) year from
the date of this resolution, whichever occurs
first, Condition Nos. 1, 3, 4, 9, 10, 13, 14,
20, 22, and 28, herein-mentioned, shall be
complied with."
BE IT FURTHER RESOLVED that new Condition No. 28 be, and
the same is hereby, added to Conditional Use Permit No. 3299 as set
forth in Resolution No. 90R-313, to read as follows:
"28. That a tract map to record the division of
subject property shall be submitted to and
approved by the City of Anaheim and then be
recorded in the Office of the Orange County
Recorder."
BE IT FURTHER RESOLVED that, except as expressly amended
herein, Resolutions Nos. 90R-312 and 90R-313 shall remain in full
force and effect.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 18th day of December,
1990.
